Res 1981 - 59 Deferring the Making of Assessments as to Van & Culligan ParcelsCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 81-59 RESOLUTION DEFERRING THE MAKING OF ASSESSMENTS AS TO VAN AND CULLIGAN PARCELS (VALLEY VIEW OAK IMPROVEMENTS IMPROVEMENT NO. 79, PROJECT NO. 8) WHEREAS, the City Clerk, with the assistance of the City Engineer, has calculated the proper amount to be specially assessed for Improvement No. 79, Project No. 8 (construction of sanitary sewer, water, storm sewer and street, curb and gutter improvements to serve Valley View Oak Addition), and +I WHEREAS, the proposed Assessment Roll for said improvements has been filed with the Clerk of the City of Mendota Heights and at all times since its filing has been open to public inspection, and WHEREAS, a hearing on said Assessment Roll was duly held at 7:30 o'clock p.m. on August 18, 1981, at the City Hall in the City of Mendota Heights, Minnesota, and �I WHEREAS, Leo Culligan and wife are the owners of the following parcels included in said Assessment Roll, to -wit: Tax Parcel No. 27-81250-01002 Tax Parcel No. 27-81250-02002 and WHEREAS, the Assessment Roll for said improvement prof a total assessment against each of the above parcels i amounts: Tax Parcel No. 27-81250-01002 - $5,823.04 Tax Parcel No. 27-81250-02002 - 5,823.04 and :t proposed the following WHEREAS, said property owners have requested that said assessments against the above-described parcels be deferred until such time {_ as such property is sold or developed with the construcltion thereon of any improvements, and l WHEREAS, Theodore C. Van and Joy R. Van, husband and wife, are the owners of certain property included in said Assessment 'Roll more particularly described as Tax Parcel No. 27-02700-030091, and { WHEREAS, the Assessment Roll for said improvement project proposed a total assessment against said Parcel No. 27-02700-03009 in the amount of $11,617.60, and WHEREAS, said property owners have previously requestedithat said Parcel No. 27=02700-03009 be subdivided and have also requested that the assessments for said improvements to be assessed at?Ithis time be assessed in their entirety against Lot 1, Block 1, Oak Point resulting from said subdivision, and WHEREAS, said property owners have requested that the total assess- ments against said Parcel No. 27-02700-03009 to be levied at this time be reduced to $5,808.80, and that the making of anlassessment as to the balance in the amount of $5,808.80 be deferre until such time as the balance of said property is sold or develope:'d with the construction thereon of any improvements, and WHEREAS, the City Council has determined that it would be in the best interests of the City of Mendota Heights to defer the making of assessments with respect to the above-described improvements as to the above-described parcels until such time as such property is sold or developed with the construction thereon of any improvements, and WHEREAS, the proposed deferment of said assessments relative to the above-described parcels would be made with the understanding that the deferred amount of said assessments plus interest accrued from August 18, 1981, at the rate of 11 percent per annum would become immediately payable upon the sale of said property or the development upon said property with the construction thereon of anylimprovements. i NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: i) 1) That the Assessment Roll for the Valley View Oak improvements (Improvement No. 79, Project No. 8) be corrected as set forth above. i I 2) That in the case of Tax Parcel No. 27-02700-031009, the deferment granted herein shall be deemed to apply i�to the balance of said lot other than and except for Lot,ll, Block 1, Oak Point. i 3) That upon the future sale or development of ariy of the above-described parcels with the construction the"eon of any improvements, the deferred amount of said assessments more particularly set forth above shall become immediately due and payable together with interest at the rate of 11 percent per annum from August 18, 1981. 11 Adopted by the City Council of the City of Mendota Heights this 18th day of August, 1981. 1� CITY COUNCIL CITY OF MENDOTA HEIGHT ATTEST :c� By ��J c O Robert G.
