Res 1982 - 19 Opposing House File 1738 Relating to Prohibiting Exclusion of Manufactured HousingCITY OF MENDOTA HEIGHTS RESOLUTION NO. 82-19 RESOLUTION OPPOSING HOUSE FILE 1738 (S.F. 1677) RELATING TO PROHIBITING EXCLUSION OF MANUFACTURED HOUSING WHEREAS, House File 1738 and Senate File 1677, as presently a being considered by the House General Legislation Committee and Senate Energy and Housing Committee would amend Minnesota Statutes 1980, Section 462.357, Subdivision 1, "Authority for Zoning"}; and WHEREAS, it appears that the sole intent of said proposed legislation is to further limit municipal authority by prohibiting municipal exclusion of mobile homes, as redefined "manufactured homes" in 1981, by amendment to Minnesota Statutes 327.31, Subdivision 6; and WHEREAS, Minnesota Statutes 462.357 affirms the municipal authority and in- herent right to exercise its wisdom and discretion in determining local housing needs and desires; and WHEREAS, HF 1738 and SF 1677 undermine the right of the citizens of the State through their elected local officials to determine and enforce local zoning and building regulations. ;! NOW THEREFORE BE IT RESOLVED that the City Council of the City of Mendota Heights opposes HF 1738 and SF 1677 on the basis that local zoning and housing concerns, needs and regulations are more properly addressed at the local level; and BE IT FURTHER RESOLVED that copies of this resolution be submitted to the League of Minnesota Cities, members of the Senate Energy and Hous+ing Committee, House General Legislation Committee, Senator Howard Knutson and Representative Carolyn Rodriguez; and BE IT FURTHER RESOLVED that the City Council of the City of Mendota Heights urge its legislators and the State Senate and House Committees considering HF 1738 and SF 1677 to express their confidence in the ability of local government officials to properly address local issues by opposing said proposed legislation.
