RESOLUTION NO. 82-85
RESOLUTION DENYING APPLICATION OF FEDERAL LAND
COMPANY FOR A CONDITIONAL USE PERMIT FOR A PUD
WHEREAS, Federal Land Company has applied for a variance and a`conditional use
permit for a Planned Unit Development (PUD) to be located in Lot 9, Auditor's
Subdivision No. 4, Lilydale, and
WHEREAS, that portion of Federal Land Company's application requesting a
variance from the ten acre area requirement was granted by the City Council on
August 3, 1982, in order to allow Federal Land Company to process its application
for a PUD, and
WHEREAS, the City Council, in granting said variance, expressly refused to make
any commitment as to the approval of the PUD application, and
WHEREAS, Federal Land Company's prior application for a PUD in the same
location was denied by the City Council on January 20, 1981, and
WHEREAS, the Mendota Heights Planning Commission, at a regular meeting held on
September 28, 1982, voted unanimously to recommend denial of the present PUD
application (hereinafter the "application"), and
WHEREAS, the application was presented to the Mendota Heights City Council and
a public hearing on the application was duly held at a regular Council meeting on
October 5, 1982, and
WHEREAS, at said meeting, all persons interested in the application were afforded
an opportunity to present their views and objections to the application, and
WHEREAS, the City Council has considered the application and hasi had a thorough
discussion in consideration of the matter, and
WHEREAS, the site of the proposed PUD is an R-1 One -Family Residential District,
and
WHEREAS, the revised site plan includes fourteen (14) dwelling units consisting of
seven buildings of two dwelling units each, and
WHEREAS, the residential areas contiguous to the proposed site have been
developed with single-family homes, and
WHEREAS, the proposed development of town homes fails to utilize the relatively
small amount of open space available on the site in a way which would be
compatible with contiguous properties, and
WHEREAS, Federal Land Company has failed to provide sufficient developmental
detail on the revised site plan, since said revised plan does not show topography,
landscaping, and other elements of the plan required by the City's PUD Ordinance,
and
WHEREAS, the proposed development presents a storm drainag problem with

respect to adjacent property to the east of the proposed site, and
WHEREAS, Federal Land Company has failed to provide sufficient detail as to the
manner in which adequate drainage will be accomplished on the proposed site, and
WHEREAS, the revised site plan fails to adequately provide for visitor parking, and
WHEREAS, the City Council, for all of the above-described reasons, finds that the
proposed PUD:
1) Would be inconsistent with the City's Comprehensive Plan;
2) Would not be an effective and unified treatment of the development
possibilities on the project site;
3) Fails to provide for the preservation of unique natural amenities;
4) Fails to harmonize with the existing development
surrounding the project site; and
5) Does not achieve the purposes of a PUD development as set forth in the
ordinance but simply attempts to establish an R-2 Two Family
Residential District without going through the formalities, of rezoning.

NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1) Based on the considerations set forth above, and based on all of the files,
records and proceedings herein, it is hereby determined that the
application for a conditional use permit for a PUD as described above be
and hereby is in all respects denied.
Adopted by the City Council of the City of Mendota Heights this 19th day of
October, 1982.
