RESOLUTION NO. 83- 43
RESOLUTION APPROVING CONDITIONAL USE PERMIT FOR
CONGREGATION SONS OF JACOB
WHEREAS, Congregation Sons of Jacob has applied for a Conditional Use
Permit to construct a Synagogue on property described below and for purposes
directly related thereto; and
WHEREAS, the property for which said application for a conditional use
permit has been filed is classified as a "R-1" One Family Residential District
under the City Zoning Ordinance and is more particularly described as the
following property situated in the City of Mendota Heights in Dakota County,
Minnesota, to -wit:
The West 726 feet of the East 1,386 feet of the South 660 feet
of the Northeast quarter of Section 27, Township 28, Range 23,
except the South 421.5 feet of the West 130 feet thereof,
and
WHEREAS, the application for said conditional use permit has been duly
considered by the City Planning Commission and the Planning Commission has
recommended the approval of said conditional use permit subject to the following
conditions:
1. That construction limits shall not extend greater than four feet
into either of the screening or the screening zones on the north
and west side of the parking lot.
2. That the parking lot be asphalt and curbed, and subject to the engin-
eering staff review of provisions for surface drainage and other engin-
eering details of the site.
3. That the building be and development occur as indicated on plans dated
April 19, 1983 (and the date of the previous plan submitted).
4. That the building be constructed in accordance with plans submitted.
5. That additional landscaping be added to the front of the structure
(south side) subject to staff approval and to be completed within 18
months after construction.
6. That the site contain hooded, non -sodium lights.
7. That no parking be permitted on public streets during the time of
services.
8. That landscaping plans, as submitted at the April 26, 1983 Planning
Commission meeting and as discussed, be followed.
and
WHEREAS, The City.Council has held a public hearing on said application all as
required unter the provisions of the City Zoning Ordinance; and
WHEREAS, all persons interested in said conditional use permit application
have been given-the-opbortunity to be heard with respect thereto; and
WHEREAS, the City Council is of the opinion_that the above-described property
would be suitable for synagogue use and would not create a nuisance or be detrimental
to the health, safety or welfare of the immediate neighborhood or the community in
general; and that the proposed use would not create any traffic congestion or
hazards greater than would be the case if the site were used for single family resid-
ential development; and that the proposed use is in harmony with the general purpose
and intent of the City's Zoning Ordinance and Comprehensive Plan.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota
Heights, Minnesota, as follows:
1. The application of Congregation Sons of Jacob for a Conditional Use
Permit to use the above-described property for a religious institution
(a synagogue) and purposes directly related thereto is hereby approved subject
to the following conditions:
a. Detailed light standards with hooded, non -sodium lights shall be
provided upon the site.
b. There shall be no parking permitted on adjacent public streets during
the time of services.
c. Prior to commencement of the synagogue building, a detailed landscaping
plan showing types of shrubs and trees shall be submitted for;btaff
approval.
d. That construction limits shall not extend greater than four feet into
either of the screening or the screening zones on the north and west
side of the parking,lot.
ee That the parking lot be asphalt and curbed, and subject to the engineering
staff review of provisions for surface drainage and other engineering
details of the site.
f. That the building be and development occur as indicated on plans dated
April 19, 1983 (and the date of the previous plan submitted).

h. That additional landscaping be added to the front of the structure (south
side) subject to staff approval and to be completed within 18 months
