Res 1983 - 71A Deferring Payment of Assessments as to McNeill & Metropolitan Airports Commission PropertyCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 83-71A RESOLUTION DEFERRING PAYMENT OF ASSESSMENTS AS TO MCNEILL AND METROPOLITAN AIRPORTS COMMISSION PROPERTY (IMPROVEMENT NO. 82, PROJECT NO. 2) WHEREAS, the City Clerk, with the assistance of Edward F. Kishel, Engineer for the Citylof Mendota Heights, has calculated the proper amount to be specially assessed for Improvement No. 82", Project No. 2 (construction of sanitary sewer, watermains, storm , sewers and streets to serve the Metropolitan Airports Commission Property and adjacent area); and WHEREAS, the proposed assessment roll for said improvements has been filed with the Clerk of the City of Mendota Heights and at all times since its filing has been open to public inspection; and WHEREAS, the hearing on said assessments was duly held at 7:30 o'clock p.m. on September 6, 1983 at the City Hall of the City of Mendota Heights, Minnesota; and WHEREAS, the proposed assessment roll for said improvements was duly adopted by the City Council on September 6, 1983; and WHEREAS, John McNeill1is the owner of certain property more particularly described as Tax Parcel No. 27-03300-050-03 (The "McNeill Property"); and WHEREAS, said John McNeill has requested that the assessment against said parcel be deferred until the earlier of (i) the development of said parcel for commercial or industrial purposes, or (11) the connection of any current or future improvements on said parcel to any ofithe utility systems being constructed pursuant to the subject project; and 4 WHEREAS, the Metropolitan Airports Commission is the owner of certain property moredparticularly described as Tax Parcels 27- 29000-122-06, 27-03300-040-01 and 27-03300-010-02 (The "M.A.C. Property"); and # 1 WHEREAS, the Metropolitan Airports Commission has requested that the assessments against said parcels be deferred until such time as said parcels are further developed; and t I WHEREAS, the City Council has determined that it would be in the best interests of the City of Mendota Heights to defer the payment of assessments with respect to the above-described improvements as to the properties described above; and NOW, THEREFORE, IT IS HEREBY RESOLVED, by the City Council of the City of Mendota Heights, Minnesota, as follows: 1. That the assessment roll for Improvement No. 82, Project No. 2 be corrected to reflect the deferment of the assessments levied against the McNeill Property and the M.A.C. Property. 2. That upon the future development or construction upon the McNeill Property of any improvement for industrial or commercial purposes, or upon the connection of said parcel to any of the utility systems being constructed in connection with the subject project, whichever shall first occur, the deferred amount of said assessments more particularly set forth in the assessment roll will be immediately due and payable, together with interest at the rate of ten percent (10%) per annum from September 6, 1983. a. That upon the development of any of the M.A.C. Property necessitating the issuance of a building permit from the City of Mendota Heights, the deferred amount of said assessments more particularly set forth in the assessment roll will be immediately due and payable, together with interest thereon at the rate of ten percent (100) per annum from September 6, 1983. 4. That the City Attorney is hereby directed to file a certified copy of this Resolution in the office of the County Recorder of Dakota County, Minnesota so that any future purchaser or party in interest relative to any of the above-described parcels will be on notice relative to the deferred assessments described above.
