RESOLUTION NO. 83- 95
RESOLUTION APPROVING PLANNED UNIT DEVELOPMENT
FOR LEXINGTON HEIGHTS APARTMENTS
WHEREAS, Roger R. Riley has appled for a Conditional Use Permit to
construct a Planned Unit Development consisting of a three building, 225
unit apartment complex on property located on the east side of Lexington
Avenue, south of Wagon Wheel Trail and north of Mendota Heights Road; and
WHEREAS, such property is described as all that part of the S1 of the
NWS and of the South 10 acres of the NW14 of Section 35, Township 28, Range
23, lying westerly of Minnesota Department of Transportation right-of-way,
Plat No. 19-37; and
WHEREAS, Roger Riley has been granted a variance from the density
requirement to construct 225 units on an 18.2 acre site;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Mendota
Heights, that the Conditional Use Permit for the Planned Unit Development be
approved subject to the following conditions:
1. An approved drainage plan;
2. Proper erosion control measures;
3. Construction to meet City staff interpretations of the approved
plans and specifications.
4. Driveway radii entering underground parking areas increased to
meet Fire Marshal's approval.
5. Execution of a Developer's Agreement addressing such items as a
park donation and other items.
Adopted by the City Council of the City of Mendota Heights this First day of
November, 1983.
