Res 1985 - 89 Approving Vacation of 1st Avenue Street Easement Located within Lot 8, Block 2, Ivy Falls West AdditionCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 85- 89 11 .RESOLUTION APPROVING VACATION OF FIRST AVENUE STREET EASEMENT LOCATED WITHIN LOT 8, BLOCK 2, IVY FALLS WEST ADDITION WHEREAS, Roger and Barbara Riley is the current record owner of Lot 8, Block 2, of the property included within the plat of Ivy Falls West Addition, Dakota County, Minnesota; and WHEREAS, a petition has been duly presented to the City Council of the City of Mendota Heights by Roger and Barbara Riley for the vacation of a 30 foot wide street and utility easement particularly described as follows: That part of the following described parcel: A 30 foot strip of land lying immediately adjacent to and northerly of the following described line: Beginning at the southeast corner of Lot 7, Vandalls Outlots, Dakota County, Minnesota, thence West along South line of said Lot 7 a distance of 475 feet thence terminating. lying within Lot 8, Block 2, Ivy Falls West Addition, according to the recorded plat thereof on file in the office of the County Recorder, Dakota County, Minnesota. WHEREAS, a notice of hearing on said vacation has been duly published and posted more than two weeks before the date scheduled for the hearing on said vacation, all in accordance with the applicable Minnesota Statutes; and WHEREAS, a public hearing was held on said vacation.on November 19, 1985, at 8:00 o'clock P.M., at the City Hall of the City of Mendota Heights; and WHEREAS, the City Council then proceeded to hear all persons interested in said vacation and all persons were afforded an opportunity to present their views and objections to the granting of said petition. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1. That the vacation of the street and utility easement described above, situated in the City of Mendota Heights, is in the best interest of the public and the City, and is not detrimental to the health, safety and welfare of the community. 2. That the above described street and utility easement be and the same is hereby vacated.
