Res 1985 - 20 Authorizing the Water Connection to Riverain Condominiums, Lilydale, MNCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 85- 20 RESOLUTION AUTHORIZING THE WATER CONNECTION TO RIVERAIN CONDOMINIUMS, LILYDALE, MINNESOTA WHEREAS, the City of Mendota Heights has previously provided central water ser- vice to properties outside the municipal boundaries; and WHEREAS, Trucker -Sheehy Constructors, Inc., has received approval from the City of Lilydale to construct a 29 unit condominium along State Trunk Highway No. 13; and WHEREAS, the City of Lilydale has authorized the City of Mendota Heights to grant water service to Riverain Condominiums. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: That water service be granted to Trucker -Sheehy Constructors, Inc. for Riverain Condominiums subject to: 1. Payment of the amount of $12,500.00 to the City of Mendota Heights by Trucker -Sheehy Constructors, Inc. 2. The applicant agrees to install a fire hydrant on the north side of Trunk Highway 13 (or such other location acceptable to the fire marshal). 3. The applicant agrees to pay any and all other costs associated with the installation of the new watermain under Trunk Highway 13, then staff is autho- rized to issue a water permit to connect to the City's watermain. The main installed by the applicant running from the City's existing main on the South side of Highway 13 to the North side of Highway 13 may be the same size as the City's main. Further, staff is authorized to agree with Trucker -Sheehy Constructors, Inc., that no persons other than the owner or owners of the Riverain Condominiums shall be entitled to connect to or utilize the internal main thereby paid for or constructed by Trucker -Sheehy Constructors, Inc., with- out its prior written consent, the granting of which may be conditioned only upon the payment of a reasonable charge to Trucker -Sheehy Constructors, Inc. This agreement shall not affect any other present or future connection to the City's existing main along Highway 13 and shall be in addition to and not in derogation of any consents, permits, assessments, charges or other fees imposed by the City of Mendota Heights.
