Res 1986 - 39 Requesting a Variance to the M.S.A. Standards for MH Construction East of Hwy 149, M.S.A. Project No. 140-103-05City of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 86- 39 RESOLUTION REQUESTING A VARIANCE TO THE M.S.A. STANDARDS FOR MENDOTA HEIGHTS ROAD CONSTRUCTION EAST OF TRUNK HIGHWAY 149, DODD ROAD, M.S.A. PROJECT NO. 140-103-05 (IMPROVEMENT NO. 83, PROJECT 7A) WHEREAS, Mendota Heights Road is an existing City M.S.A Route; and WHEREAS, the plans for the project were approved by the District 9 M.S.A. Office in 1983 and inadvertently never approved by the Director of State Aid; and WHEREAS, the Minnesota Department of Transportation has upgraded Mendota Heights Road east of Trunk Highway 149, Dodd Road; and WHEREAS, the State Aid Engineer has now reviewed and found that the plans meet State Aid requirements; and WHEREAS, projects are only eligible for State Aid funds if the plans are approved prior to the award of a contract. NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, to request a variance to the M.S.A. Rule Number 8820.2800 Subp. 2, that states that only projects for which plans are approved by the State Aid Engineer prior to the award of a contract are eligible for state aid construction funds.
