RESOLUTION NO. 86- 36
RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF
PLANS AND SPECIFICATIONS FOR SANITARY SEWERS, WATER AND STORM SEWERS
CONSTRUCTION TO SERVE LAKE LEMAY PHASE I AND ADJACENT AREAS
(IMPROVEMENT NO. 85, PROJECT NO. 6)
WHEREAS, a public hearing was held on the 4th day of March, 1986, at 8:00 o'clock
P.M. in the City Hall of the City of Mendota Heights, Minnesota pursuant to
resolution duly adopted by the City Council of the City of Mendota Heights on the
question of the proposed construction of the following described improvements:
The construction of an extension to the City's sanitary sewer system, in-
cluding appurtenances and incidentals thereto, and the acquisition of ease-
ments, and the reconstruction where necessary of streets and easements in
the area hereinafter more particularly described.
The construction of an extension to the City's water distribution system
including appurtenances and incidentals thereto, and the acquisition of
easements, and the reconstruction where necessary of streets and easements
in the area hereinafter more particularly described.
The construction of a storm sewer system including appurtenances and inci-
dental thereto and the acquistion of easements, in and for the area herein-
after more particularly described.
WHEREAS, due publication of the notice of public hearing on said proposed con-
struction has been attended to; and
WHEREAS, mailed notice of said hearing has been mailed more than 10 days before
the date of said hearing to the owners of each parcel situated within the area
proposed to be assessed, all in accordance with the applicable Minnesota
Statutes, and
WHEREAS, the City Engineer reported that the proposed improvement and construc-
tion thereof were feasible and desirable and further reported on the proposed
costs of said improvements and construction thereof; and
WHEREAS, the area proposed to be assessed for said improvements is situated
within the City of Mendota Heights in Dakota County, Minnesota and is more
particularly described as follows:
Those parts of Section 34, North of the Milwaukee Railroad right-of-way,
Southwest of Trunk Highway 55 and East of future Trunk Highway 13 right-of-
way.
WHEREAS, the City Council then proceeded to hear all persons interested
in said improvement and all persons were afforded an opportunity to
present their views and objections to the making of said improvements.
WHEREAS, the City Engineer recommended the project be constructed in two phases,
Phase I consisting of the construction of sanitary sewers and watermains as
described in the feasibility report, and storm sewers constructed to a point 500
feet north and 580 feet east of Transport Drive, and Phase II consisting of the
construction of the remaining storm sewers as described in the feasibility re-
port.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota
Heights, Minnesota as follows:
1. That it is advisable, feasible, expedient and necessary that the City of
Mendota Heights construct Phase I of the above described improvements,
and it is hereby ordered that said improvement be made.
2. That the City Engineer be and he is hereby authorized and directed to
prepare plans and specifications for said improvement.
3. That said improvement shall hereafter be known and designated as
Improvement No. 85, Project No. 6.

1986.
