Res 1986 - 43 Rescinding Resolution No. 78-60 & Establishing Charges for Utility Connections Outside Municipal BoundariesCITY OF MENDOTA HEIGHTS Dakota County, Minnesota RESOLUTION NO. 86-__ 413 RESOLUTION RESCINDING RESOLUTION NO. 78-60 AND ESTABLISHING CHARGES FOR UTILITY CONNECTIONS OUTSIDE MUNICIPAL BOUNDARIES WHEREAS, in the past the City of Mendota Heights has provided utility service to properties outside of the City's municipal boundaries and has imposed connection charges for such services based on a formula established by Resolution No. 78-60; and WHEREAS, it was the intent of said Resolution to provide a means for outside connections to occur at a coat similar to the amortized assessments for Mendota Heights properties which were served by the utility mains affecting the outside connections; and WHEREAS, the connection charge formula imposes interest charges substantially exceeding those which would be levied against Mendota Heights properties and requires a surcharge for general obligation contributions and non-specified governmental costs which exceeds City obligations; and WHEREAS, while it was not the intent of the Resolution, the affect of the cost formula has been to discourage outside connections; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Mendota Heights that Resolution No. 78-60 is hereby rescinded and the connection charges re-established as follows: 1. That water and sewer connection charges for properties outside of the municipal boundaries be computed based on the sum of three elements in the following order of computation: a. Front foot assessment based on the special assessments levied for the original improvement project in which the utility was installed; b. A surcharge of 15% to partially pay for General Obligation contributions and other non-specified governmental costs; c. Interest on the principle amount arrived at in steps a. and b. above in the same percentage charged under the original project assessment roll, accruing from the date of the original assessment roll adoption. 2. That the total connection charge computed in step 1 be payable after approval of the connection by the City Council and prior to actual connection; 3. That the applicant submit an escrow deposit to cover anticipated City costs for plan review, inspection costs . and other engineering services which may be required of the City. BE IT FURTHER RESOLVED, that the provisions of Ordinance No. 806 and Ordinance No. 807 relative to Water Availability Charges and Water Surcharges and the provisions of Ordinance No. 803 and Ordinance No. 805 relative to sewer rental chargee and Metropolitan Waste Control Commission Sewer Availability Charges shall be applicable to all outside utility - connections.
