RESOLUTION DENYING JAMES RILEY REZONING,
PLANNED UNIT DEVELOPMENT AND SUBDIVISION APPLICATION
WHEREAS, James Riley has applied for approval of a proposed planned unit
development and subdivision application in connection with, along with rezoning of,
approximately 118 acres of property located in the southeast area of Mendota Heights
adjacent to Mendota Heights Road between Dodd Road and Delaware Avenue, said
property being described as "Part of the East half of the Southwest Quarter of Section
36, Township 28, Range 23" (the "Property"); and
WHEREAS, said application was submitted to the City on May 5, 1986; and
WHEREAS, the Comprehensive Plan of the City of Mendota Heights currently
designates the Property for use only in connection with single family residential
dwellings; and
WHEREAS, in November, 1985, the Mendota Heights City Council resolved to amend
the Comprehensive Plan to designate the Property for use in connection with multi-
family housing; and
WHEREAS, such amendment to the Comprehensive Plan will be effective only upon
approval by the Metropolitan Council; and
WHEREAS, the Metropolitan Council has not formally approved such Comprehensive
Plan amendment; and
WHEREAS, the City Council finds that the proposed use and subdivision of the
Property:
1. Would be inconsistent with the City's Comprehensive Plan, as in effect as
of the date of this Resolution;
2. Would not be an effective and unified treatment of the development
possibilities of the Property;
3. Would require excessive grading, thereby resulting in the destruction or
damage to the existing natural amenities of the Property;
4. Would include excessive paved or otherwise impervious surface, with in-
adequate open and green space;
5. Would be contrary to the health, safety, and general welfare of the
community;
6. May constitute a threat to the property values in the surrounding area; and
7. Would not be in harmony with the existing developments in the surrounding
area.
WHEREAS, the City finds that the granting of the application would be inconsistent
with the intent and purposes of the City's planned unit development ordinances; and
WHEREAS, a hearing has been held on such requested application and all persons in
favor and opposed to the granting of said application have had the opportunity to
submit their comments and positions to the City Council.
NOW, THEREFORE, IT IS HEREBY RESOVLED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. Based on the considerations set forth above, and based on all of the files,
records and proceedings herein, it is hereby determined that the applica-
tions for rezoning of the Property, approval of a planned unit development
thereon and subdivision thereof, as submitted by James Riley to the City
of Mendota Heights and described above, be and they are hereby in all
respects denied.
Adopted by the City Council of the City of Mendota Heights this 1st day of July,
1986.
