Res 1987 - 32 Approving Vacation of a Utility Easement (2)City of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 87-32 RESOLUTION APPROVING VACATION OF A UTILITY EASEMENT WHEREAS, Jeff Schoenwetter and Halley Land Corporation are the current record owners of the property included within the plat of Park Place Subdivision, Dakota County, Minnesota; and WHEREAS, a petition has been duly presented to the City Council of the City of Mendota Heights by the above property owners for the vacation of a 20 foot wide utility easement particularly described as follows: That part of the South twenty four feet (S24') of the North Thirty (30) acres 'of Government Lot Eight (8), Section Twenty Three (23), Township Twenty Eight (28) North, Range Twenty Three (23), West, Dakota County, Minnesota, lying east- erly of the centerline of the Northern States Power Company highline easement (which centerline lies parallel to and is 962.50 feet more or less westerly of the west line of Wachtler Avenue, and A strip of land twenty (20) feet in width over and across the West forty (40) rods of the South Ten (10) acres of Government Lot Eight (8), Section 23, Town- ship Twenty Eight (28), Range Twenty Three (23) West, the. centerline of which is described as follows: Beginning on the north line of the hereinabove first described tract at a point 25 feet east of the centerline of the Northern States Power Company propane line easement (which centerline lies parallel to and is 9371 feet, more or less, westerly of the west line of Wachtler Avenue); thence proceeding southerly para- llel to the centerline of said propane line easement to a point 50 feet north of the south line of said Government Lot Eight (8), thence proceeding westerly parallel to and 50 feet north of said south line to a point 85 feet west.of the said centerline of the said propane line easement, thence deflecting at an angle of 45° to the left and continuing to the said south line and there terminating. WHEREAS, a notice of hearing on said vacation has been duly published and posted more than two weeks before the date scheduled for the hearing on said vacation, all in accordance with the applicable Minnesota Statutes; and WHEREAS, a public hearing was held on said vacation on April 7, 1987, at 8:00 o'clock P.M., at the City Hall of the City of Mendota Heights; and WHEREAS, the City Council then proceeded to hear all persons interested in said vacation and all persons were afforded an opportunity to present their views and objections to the granting of said petition. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1. That the vacation of the utility easement described above, situated in the City of Mendota Heights, is in the best interest of the public and the City, and is not detrimental to the health, safety and welfare of the community. 2. That the above described utility easement be and the same is hereby vacated. 3. That the City Clerk be and is hereby authorized and directed to prepare and present to the proper Dakota County officials a notice of completion of these vacation proceedings, all in accordance with the applicable Minnesota Statutes.
