RESOLUTION NO. 89- 87
RESOLUTION APPROVING CONDITIONAL USE PERMIT FOR TEMPORARY
CLASSROOMS, INDEPENDENT SCHOOL DISTRICT 197
WHEREAS, Independent School District 197, has made
application, on behalf of Mendota Elementary School, for a
conditional use permit to construct two temporary, free-standing
wood frame classrooms adjacent to the west side of Mendota
Elementary School; and
WHEREAS, the Planning Commission conducted a public hearing
on July 25, 1989 to consider an application for a Conditional Use
Permit request for construction of said temporary classrooms; and
WHEREAS, based upon the public record transcribed on July
25, 1989 the Mendota Heights Planning Commission recommends to
the Mendota Heights City Council that the Conditional Use Permit
be granted conditioned upon:

A five year limitation upon the Conditional Use Permit and
requiring a reapplication to continue the use of the
temporary structures after a five year period has passed.
That the two large trees located near the proposed expanison
not be removed and that they should be replaced if damaged
during construction; and
WHEREAS, the City Council of Mendota Heights conducted a
public hearing on August 1, 1989 and stated that safety
precautions should be taken by School District 197 for the
sliding/sledding hill adjacent to the proposed temporary
classrooms as a condition to the approval of a Conditional Use
Permit.
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of
the City of Mendota Heights that the proposed conditional use
would have no adverse effect on the health, safety and general
welfare of the citizens of the community or surrounding land;
BE IT FURTHER RESOLVED, that construction of said temporary
classrooms would not be adverse to the general purpose and intent
of the Zoning Ordinance;
BE IT FURTHER RESOLVED, that said conditional use permit for
construction of temporary classrooms at Mendota Elementary School
be approved as presented and proposed, on the condition that:
1. There is a five year limitation to use of the temporary
classrooms, with a reapplication necessary to renew the use
of said temporary structures after a period of five years.

2. The two large trees located near the proposed expansion not

3. Safety precautions should be taken by School District 197 to
ensure the safety of children using the sliding/sledding
hill adjacent to the proposed temporary classrooms.
