Res 1990 - 19 Approving Vacation of a Drainage & Utility EasementCity of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 90- 19 RESOLUTION APPROVING VACATION OF A DRAINAGE AND UTILITY EASEMENT WHEREAS, the City of Mendota Heights is the current record owner of a drainage and utility easement as described as follows; That part of a 10.00 foot dedicated drainage and utility easement along the southeast line of Lot 7, Block 2, Kensington P.U.D., Dakota County, Minnesota, lying northerly of the following de- scribed line:afore mentioned plat, Dakota County, Minnesota, Commencing at the southeast corner of said Lot 7; thence North 45 degrees 45 minutes 59 seconds East, assumed bearing, along the southeast line of said Lot 7, a distance of 94.50 feet; thence North 44 degrees 14 minutes 01 seconds West, a distance of 10.00 feet to the northwesterly line of said easement, and the actual point of beginning; thence South 36 degrees 12 minutes 02 seconds West, a distance of 7.75 feet; thence North 53 degrees 47 minutes 58 seconds West, a distance of 1.30 feet and there terminating. WHEREAS, a notice of hearing on said vacation has been duly published and posted more than two weeks before the date scheduled for the hear ing on said vacation, all in accordance with the applicable Minnesota Statutes; and WHEREAS, a public hearing was held on said vacation on April 3, 1990, at 7:45 o'clock P.M. or as soon as possible thereafter, at the City Hall of the City of Mendota Heights; and WHEREAS, the City Council then proceeded to hear all persons interest- ed in said vacation and all persons were afforded an opportunity to present their views and objections to the granting of said petition. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1. That the vacation of the drainage and utility easement de- scribed above, situated in the City of Mendota Heights, is in the best interest of the public and the City, and is not detrimental to the health, safety and welfare of the community. 2. That the City Clerk be and is hereby authorized and directed to prepare and present to the proper Dakota County officials a notice of completion of these vacation proceedings, all in ac- cordance with the applicable Minnesota Statutes.
