Res 1990 - 22 Approving a Conditional Use Permit to Allow MN Indoor Soccer & Training (MIST) to Construct & Operate an Indoor Soccer FacilityCITY OF MENDOTA HEIGHTS DAROTA COUNTY, MINNESOTA RESOLUTION NO. 90-22 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW MINNESOTA INDOOR SOCCER AND TRAINING (MIST) TO CONSTRUCT AND OPERATE AN INDOOR SOCCER FACILITY WHEREAS, MIST has applied for a Conditional Use Permit to construct and operate an indoor soccer facility at the intersection of Northland Drive and Mendota Heights Road; and . WHEREAS, the required public hearings were held by the Planning Commission; and WHEREAS, the Planning Commission recommended approval of a Conditional Use Permit to Allow MIST to construct and operate an indoor soccer facility, subject to the following conditions: 1. That the development will occur in accordance with the design as submitted at the April 17, 1990 City Council meeting and dated April 6, 1990; 2. In the event that there is not adequate parking for the participatory sport use of the structure, then additional parking would be added as required by the City and as indicated on the proof of parking drawing as shown on April 6, 1990 revised plan; 3. There will be no heating or air conditioning units mounted on the roof visible from contiguous streets; 4. In the event that the building is reused for office/warehouse purposes, the alternative fascade design is implemented as submitted by the applicants and that the additional parking proposed in the parking plan submitted is effectuated; 5. Final engineering and landscape plans are subject Staff approval; 6. That an expanded drop off area be developed in front of the building; 7. That a three foot (3') retaining wall along the east property line be constructed in order to maintain a 3:1 slope from the property line to the back foundation of the building; 8. That easement should be sought from MnDOT to remove the need for a retaining wall along the east property line; 9. That security lighting be installed in the parking lot. � 10. That retail sales that are not supportive of participative athletics be excluded and be of the nature of a pro shop serving the activities of the indoor soccer facility. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit to allow MIST to construct and operate an indoor soccer facility be granted subject to said conditions.
