Res 1991 - 33 Approving Vacation of a Street Right-of-Way� City of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 91-34 RESOLUTION APPROVING VACATION OF A STREET RIGHT-OF-WAY WHEREAS, the City of Mendota Heights is the current record owner of a street right-of-way as described as follows; That part of the following described property situated in Dakota County, Minnesota: That part of Lexington Avenue as platted in MEDALLION INDUSTRIAL PARK, on file and of record in the office of the County Recorder, Dakota County, Minnesota, lying southeasterly of a line parallel with and distant 100.00 feet easterly and southeasterly of a boundary line of MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY PLAT NUMBER 19-37, on file and of record in the office of the County Recorder, Dakota County, Minnesota, designated as right of way corners B1 to B2 to B3 to B4 to B5 and northerly of a line being parallel with and distant 60.16 feet northerly of the south line of the Northeast Quarter of the Southeast Quarter of Section 34, Township 28 North, Range 23 West. and WHEREAS, a notice of hearing on said vacation has been duly published and posted more than two weeks before the date scheduled for the hearing on said vacation, all in accordance with the applicable Minne- sota Statutes; and WHEREAS, a public hearing was held on said vacation on June 18, 1991, at 8:00 o'clock P.M. or as soon as possible thereafter, at the City Hall of the City of Mendota Heights; and WHEREAS, the City Council then proceeded to hear all persons interest- ed in said vacation and all persons were afforded an opportunity to present their views and objections to the granting of said petition. NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: . �'� 1. That the vacation of the street right-of-way describ�d above, situated in the City of Mendota Heights, is in the best interest of the public and the City, and is not detri- mental to the health, safety and welfare of the community. 2. That the above described street right-of-way be and the same is hereby vacated reserving from said vacation utility easement over, under and across the full extent of the herein described street, for drainage and utility purposes.
