Res 1992 - 31 Approving Vacation of StreetsCity of Mendota 8eights Dakota County, Miaaesota RESOLIITION NO. 92-31 RESOL'[TTION APPROVING VACATION OF $TREETS DJHEREAS, the City of Mendota Heights is the current record owner of streets named West Street, McDonald Street, Teeple Street and Kirchner Avenue between the north line of Butler Avenue to the south line of Valley Lane extended westerly in Mendota Heights, Dakota County, Minnesota; and D�IHEREAS, a notice of hearing on said vacations has been duly published and posted more than two weeks before the date scheduled for the hearing on said vacation, all in accordance with the applicable Minnesota Statutes; and D�SEREAS, a public hearing was held on said vacation on June 2, 1992, at 8:00 o'clock P.M., at the City Hall of the City of Mendota Heights; and �SEREAS, the City Council then proceeded to hear all persons interested in said vacation and all persons were afforded an opportunity to present their views and objections to the granting of said petition. NOW THEREFORE, IT IS BEREBY RESOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1. That the vacation of the streets described above, situated in the City of Mendota Heights, is in the best interest of the public and the City, and is not detrimental to the health, safety and welfare of the community. 2. That the above described street vacations be and the same is hereby vacated, reserving from said vacation a permanent drainage and utility easement over and across vacated Kirchner Avenue, and reserving the center 10 feet for a trail easement. 3. That the City Clerk be and is hereby authorized and directed to prepare and present to the proper Dakota County officials a notice of completion of these vacation proceedings, all in accordance with the applicable Minnesota Statutes.
