Res 1993 - 05 Acknowledging Receipt of 3 Formal Special Assessment Appeals Related to the Ivy Falls Creek Improvement Project & Clarifying Procedural Requirements Associated with those Appealsr � N CITY OF MENDOTA SEIGHTS DAROTA COUNTY, MINNESOTA RESOI,UTION NO. 93 -05 A RESOLUTION ACRNOWLEDGING RECEIPT OF THREE FORMAL SPECIAL ASSESSMENT APPEALS RELATED TO TIiE IVY FALLS CREER IMPROVEI�2LNT PROJECT AND CLARIFYING PROCFsDUR.AL REQUIREMENTS ASSOCIATED WITA THOSE APPEALS WHEREAS, on December 1, 1992 the City Council conducted a formal public hearing and adopted an assessment roll related to the Ivy Falls Creek Assessment No. 91, Project No. 6, and �I3EREA5, on December 15, 1992 the City Council did make an adjustment to the assessment roll by decreasing the assessment to each of the thirty-one abutting property owners by a factor of ten percent, and WHEREAS, the City Council has called for a public hearing on the revised assessment roll for February 16, 1993, and WHEREAS, three property owners have filed with the Dakota County District Court their Notice of Appeal of the special assessments levied against their property, and �SEREAS, there has been some question as to whether or not these property owners will then be required to file additional notices of appeal with the District Court subsequent to the February 16, 1993 public hearing, and WiiEREAS, it is not the intent of the City of Mendota Heights to require additional procedural activity on the part of these three property owners to further preserve their right to appeal the City Council's assessment decisions with respect to their property. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Mendota Heights that it acknowledges receipt of a"Notice of Case Filing" from Dakota County District Court with respect to the following special assessment objections: Allan J. Taylor, et al. Case No. C1-93-6009 David A. Libra and Mary M. Libra, Case No. C9-93-6064 Joan 0'Brien - Case file not yet assigned �. BE IT FURTHER RESOLVED that the City will not require the filing of additional Notices of Appeal with the Dakota County District Court by the above identified property owners.
