A RESOLIITION APPROVING A CONDITIONAL IISR PERMIT AND A SIZF� VARIANCE
FOR TEMPOR.ARY BIIILDING AT THE CON�TEI�TT OF VISITATION SCHOOL FOR

9�SEREAS, The Convent of Visitation School has made application
for a Conditional Use Permit and a Size Variance for Accessory
Structures to construct a temporary building to house an Early
Childhood Montessori program, as proposed on site plans dated June
9, 1993; and
V�HEREAS, the Mendota Heights Planning Commission conducted a
public hearing on June 22, 1993 to consider said application; and
�HEREAS, based upon the public record transcribed on June 22,
1993 the Mendota Heights Planning Commission recommended to the
Mendota Heights City Council that the Conditional Use Permit and
Size Variance for Accessory Structure be approved with nine
suggested conditions; and
�PIIEREAS, The City Council has reviewed said application for a
Conditional Use Permit and Variance at their aneeting on July 6 g
1993 and continued the meeting to allow the applicant time to
consider alternative locationso and
A]SEREAS, The City Council reviewed a revised site plan at
their July 20, 1993 meeting and desired to approve the proposed
Early Childhood Montessori at the revised location.
NOW THEREFORL IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit and Size
Variance for Accessory Structure will have no adverse affect on the
health, safety and general welfare of the citizens of the community
and the surrounding land; and
BS =T FiTRTHER RSSOLVED, that construction of said temporary
building for an Early Childhood Montessori program is not adverse
to the general purpose and intent of the Zoning Ordinance; and
Bi3 IT FIIRTHER RRSOLVED, that the Conditional Use Permit and
Size Variance for Accessory Structure for an Early Childhood
Montessori program be approved according to the revised plans
proposed at the July 20, 1993 meeting, subject to the following
conditions:
1. That a revised site plan showing the new location including
all the appropriate requireanent� of Oxdinance 401, Section
5.6(2) be subanitted to the City; and
� 2. That the present landscaping be maintained throughout the
project; and
3. Proper erosion control methods be maintained throughout the
project; and
4. Any play area requirements be con�tructed in confoxmance with
State Statutese and
5. That this Conditional Use Permit be valid for a period of time
not to exceed five (5) years commencing at such time as the
building is opened for operation; and
6. That public sewer, water and electrical service be provided.
7. That this proposal be reviewed and approved by the Fire
Marshal; and
8. A color scheme for the exterior materials be submitted with
the required site plans for staff approval; and
9e That adequate parking be provided for the facility; and
10. All setbacks be identi£ied on the revised site plan.
Adopted by the City Council of the City of Mendota Heights this
20th day of July, 1993.
