Res 1993 - 42 Approving a Conditional Use Permit for Accessory Structure at 1947 Knob Rd� � � CITY OF �OT� �EIGHTS D1�iROTR COUIJ7I'YB biINNESOTA RESOI��IOId I30. 93 - 42 A ItESOLIITION �1PPROVING A COrTDITIOIQ�Ia IIS$ PERMIT F'OIt �iCCESSOR7� STRIIC�R� 1#T 1947 IINOB R0�1D WHEREAS, Mr. Clifford Baars, of 1947 Knob Road, has made application for a Conditional Use Permit for Accessory Structure to conszruct a 988 square foot, detached garage on his .property at 1947 Knob Road, as proposed on site plans dated June 9, 1993; and WHEREAS, the Mendota Heights Planning Commission conducted a public hearing on June 22, 1993 to consider said application; and 6�HEREAS, based upon the public record produced on June 22, 1993 the Mendota Heights Planning Commission recommended to the Mendota Heights City Council that the Conditional Use Permit for Accessory Structure be denied and with proposed findings of fact. �PSEREAS, The City Council heard testimony at their July 20, 1993 meeting to consider said application and a compromise was reached between the City, neighbors and applicant on a detached garage of a reduced size contingent on conditions set forth by the City Council. � N0� TSEREFORS =T IS HERSBY RESOLVED by the City Council of the City of Mendota Heights that the proposed Conditional Use Permit and Size Variance for Accessory Structure is consistent with the general welfare of the citizens of the community and the aurrounding land; and BS =T FQRTHER RESOLVED, that construction of said detached garage is consistent with the general purpose and intent of the Zoning Ordinance; and BL IT FIIRTHER RESOLVED, that the Conditional Use Permit for �< Accessory Structure at 1947 Knob Road be approved subject to the following conditions, said conditions being: 1. That the existing storage shed be removed prior to the final inspection for said detached garage. a � 2. That the existing tuck under garage be eliminated in a ananner to be permanent prior to the issuance of a building permit for said detached garage. 3. That the size of said detached garage not exceed seven hundred and twenty eight (728) square feet, with dimensions of twenty six feet (26' ) by twenty eight feet (28' ), as agreed to by the applicant. 4. That said detached garage be limited to two (2) single garage doors not to exceed eight feet (S') in height or nine feet (9°) in width. 5. That landscaping, as proposed, will be established including the placement of four (4) spruce trees along the south wall of said detached garage. 6. That said garage will be used solely for the purpose of garaging non- commercial vehicle� . �- � � -~ �'� �- -� - 7. That said garage be located � closer than fifty feet (50° ) to south lot line. 8. That said garage will be limited to a maximum of fourteen feet (14') in height.
