W�ItEAS, the City Council og the City of Iviendota eights is the off'acial governing
body of the City of Iviendota �ieights; a�d ...
WHEREAS, on a motion of Councilmembea� 5andra Krebsbach ,
seconded by Councilmember Ji 11 5mi th , the following resolution was adopted
by the affumative vote of 5 members of the Counc�l:
WHEREAS, the City of Mendota �ieights, County of Aakota, State of Miainesota, has
the right to exercise the pracedure of eminent domain in order to acquire property needed fo�
public use or purpose pursuant the Minnesota Constitution and the Laws of the State of
Minnesota and acted thereunder; and
�REAS, the City Council of the City of Mendota Heights fmds that it as necessary
as well as desirable to acc�uire the following descaibed easements fo� the stated public purposes:
A�ermanent easement for drainage purposes including the right of ingress and egress
for the City and its agents, servant and contractors to enter upon the Easement Property at all
reasonable times to construct, reconstruct, inspect, repair and maintain the City's municipal
drainage system, over, under and across the following described pmgerty:
That part of Lot 5, Block 1, Yvy �alls 2nd Addition according to the recorded plat
thereof lying northerly of a line except that portion taken by the 20 foot drainage
easement, descaibed as follows:
Commencing at the northeast property coaner of said Lot 5; thence South 45 degrees 42
minutes West a distance of 8.68 feet; thence South 85 degrees 41 minutes West a
distance of 70 feet to the beginning of the line to be described; South 77 degrees 10
minutes West a distance of 101.27 feet to a point on the north property line and said line
terniinating, located in Section 13, Township 28 North, Range 23 West, Dakota County,
Minnesota.
A temporary easement valid for a period to two years from the date and year first above
written, including the right of ingress and egress for the City and its agents, servants and
contxactoxs to enter upon the Easement Pxo�xty at all rreasonable times to construct, reconstruc�,
ans�ect, re�air and maintain the City's municipal drainage system, over, under and across the
following described pa�operty:
That part of Lot 5, Black 1, Ivy Falls 2nd Addition, according to the recorded plai
thereof, lying northerly of a line descaib�d as follows:
Commencing at the northeast corner of said lot; �hence southerly along the east line of
said lot a distance of 35 feet to the beginning of the line to be described; South 85
degrees 41 minutes West a distance of 110 f�et; thence southwesterly a dist�nce of 270
feet, anore or less, to a point on the sou�hwest lane of said lot located 40 feet
southeasterly of the most evesterly coaner of said lot and there terminatinge Said
easeanent lacated ia Section 13, Townsl�p 28 1�Torth, Range 23 eVest, Dakota County,
1!/dinnesota.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CI'1'3�
OF MENDOTA HEIGHTS IN REGULAR MEETING ASSEN�LED that those easements
described above be acquired for the stated public purposes through exercises of the City of
Mendota �ieights' powers of eminent domain.
Adopted by the Mendota Heights City Council this 3rd day of August, 1993.
