Res 1993 - 88 Approving a Wetlands Permit & a Conditional use Permit for 1780 Dodd Rd to Allow Construction of a Detached GarageCI� OF b�TDOTA ��IGHTS DAICOTAi COII�T�e �2IIQNrsSOTA RF�SOL�ION IJO. 93 - 88 A RESOIa�IOI�T �PPROVFN(� !� �TI�Y�YDS P}3RPdIT AIQD A CONDITIOY�TAIe IISE PEEtb�IT FOl� 17 � 0 DODD It01� TO ALLODP CONSTRIICTION OF A D8T1aiGHED GARP�GL WHSREAS, Mr. Gerald Deeb, of 1780 Dodd Road, has made application for a Wetlands Permit and a Conditional Use Permit for Accessory Structure to construct a 988 square foot, detached garage on his property at 1780 Dodd Roado as proposed on revised site plans submitted November 23, 1993; and QPSEREAS, the Mendota Heights Planning Commission opened a public hearing on October 26, 1993 and continued the public hearing to November 23, 1993 and reviewed said application; and &PHEREAS, lacking a quorum on November 23, 1993 those members of the Planning Commission present for the meeting, based upon the public record produced on October 26, 1993 and November 23, 1993, suggested to the Mendota Heights City Council that a Wetlands Permit and a Conditional Use Permit for Accessory Structure be approved with the following conditions: 1. Size of the garage to be less than 988 square feet, with a suggested size of 800 sqo ft. to accommodate a three car garage. 2. 3. 4. 5. Building materials and colors to match the existing house. Landscaping on Dodd Road be completed to help screen the new structure from Dodd Road. 4�SEREAS, The City Council reviewed said application for Wetlands Permit and Conditional Use Permit for Accessory Structure at their December 7, 1993 meeting and continued consideration of said application until the December 21, 1993 City Council meeting; and WHEREAS, the City Council discussed alternative plans with 21, 1993 meeting. reviewed said application and the applicant at their December NO� T�EREFOltB IT IS �F�R�BY ItLSOL�D by the City Council of the City of Mendota Heights that a Wetlands Permit and a Conditional Use Permit for Accessory Structure is consistent with the general welfare of the citizens of the community and the surrounding land; and BE IT FIIRTHER RESOLVED, that, under the conditions as listed below, construction of a detached garage is consistent with the general purpose and intent of the Zoning Ordinance; and BE IT FIIRTHER RLSOL'VSDa that the Wetlands Permit and Conditional Use Permit for Accessory Structure at 1780 Dodd Road be approved subject to the following conditions, said conditions being: 1. Size of the garage to be less than 781 sqo ft. to accommodate a three car garage. 2. The existing, tuck-under garage door may be retained as a second garage to provide additional garage spacee 3. That the detached garage's setback to the existing creek and wetlands be at least thirty-six feet (36' ); and that there be a side yard of twenty five feet (25') between the garage and southern property line, as proposed; and that the maximum vertical height of the garage from floor to peak be fifteen feet, six inches (15°, 6"), as proposed. 4. That building materials and colors match the existing house. 5. Landscaping on Dodd Road be completed to help screen the new structure from Dodd Road.
