APPROVING VACATION OF A DRAINAGE ANI� UTILITY EASEIVIENT
WHEREAS, the City of Mendota I�eights is the current record owner of a drainage and
utility easement as described as follows; and
A permanent easement for utility purposes, containing 0.09 acres, more or less, over
and across the north fifteen (15) feet of the west one hundred thirty (130) feet of the east one
hundred seventy (170) feet of Parcel 1 as described below, and the south fifteen (15) feet of
the west one hundred thirty (130) feet of the east one hundred seventy (170) feet of Parcel2
as described below. 5aid parcels are as described as follows:
Parcel 1. Commencing at a point on the south line of the Northeast Quarter (NE
1/4) of Section 33, Township 28 North, Range 23 West, Dakota County,
Minnesota, according to the United States Government Survey thereof,
said point being 1032 feet west of the southeast corner of said noriheast
quarter; thence north at right angles 345 feet; thence west at right angles
325 feet to the center line of the Sibley Highway; thence south along the
center line of saud Sibley Iiighway 345 feet to the south line of said
northeast quarter; thence east along the said south line of said northeast
� quarter, 325 feet to the place of beginning.
Parcel2. Commencing at a point 1032 feet west and 345 feet north of the southeast
, comer of the Northeast Quarter (NE 1/4) of Section 33, Township 28
North, Range 23 West, Dakota County, Minnesota, according to the
United States Government Survey thereof, thence north at right angles to
the south line of said northeast quarter 324 feet to the southwesterly line
of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company right
of way; thence noa�thwesterly along the right of way line (said right of
way line being located �'ifty (50) feet measured at right angles
southwesterly from the center line of the mai.n txack of the Chicago,
Milwaukee, St. Paul and Pacific Company) a distance of 500 feet to the
center line of the Sibley �iighway produced to intersect the said right of
way line; thence south along the center line of the said Sibley Highway
700 feet to a point 345 feet north of ihe south line of said northeast
quarter; thence east 325 feet to the point of beginning.
WHEREAS, a notice of hearing on said vacation has been duly published and posted
more than two weeks before the date scheduled for the hearing on said vacation, all ia
accordance with the applicable Minnesota Statutes; and

WHEREAS, a public hearing was held on said vacation on February 15, 1994, at 7:45
o'clock P.M., at the City Hall of the City of Mendota Heights; and
WHEREAS, the City Council then proceeded to hear all persons interested in said
vacation and all persons were afforded an opportunity to present their views and objections to
the granting of said petition.
NOW T�REFORE, IT IS �EREBY atESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows: ,
1. That the vacation of the drainage and utility easements described above, situated
in the City of Mendota Heights, is in the best interest of the public and the City,
and is not detrimental to the health, safety and welfare of the community.
2. That the above described drainage and utility easements be and the same is
hereby vacated.
3. That the City Clerk be and is hereby authorized and directed to prepare and
present to the proper Dakota County officials a notice of completion of these
vacation proceedi.ngs, all in accordance with the applicable Minnesota Statutes.
Adopted by the City Council of the City of Mendota Heights this 15th day of February,
1994.
