Res 1994 - 31 Approving a Conditional Use Permit for Accessory Structure at 1635 Dodd RoadCITY OF �NDOTA HEIGSTS DAROTA COUNTY, �lINNESOTA RESOLIITION N0. 94- 31 A RESOLIITION APPROVING A CONDITIONAL IISF3 PLRMIT FOR P,CCESSORY STRIICTI7RE AT 1635 DODD ROAD �1SEREAS, Mre James Stehr, of 1635 Dodd Road, has made application for a Conditional Use Permit for Accessory Structure to construct a 480 square foot pigeon coop on his property at 1635 Dodd Road, as proposed on site plans in Case File No. 94-07; and WHEREAS, the Mendota Heights Planning Commission conducted a public hearing on April 26, 1994 to review said application; and DaHEREAS, on April 26, 1994 the Planning Commission closed the public hearing and voted unanimously (6-0) to recommend that City Council approve a Conditional Use Permit for Accessory Structure to allow construction of a pigeon coop, as proposed, with the following condition: 1. That City Council find that the proposal will not be detrimental to the health, safety or general welfare of the community, nor will cause serious traffic congestion or hazards, nor will seriously depreciate surrounding property, and that the same is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. �HEREAS, the City Council reviewed said application for Conditional Use Permit for Accessory Structure at their May 3, 1994 meeting. NOW THEREFORE IT IS BEREBY RBSOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for Accessory Structure to allow construction of the proposed 480 square foot pigeon is consistent with the general welfare of the citizens of the community and the surrounding land; and BE IT FIIRTHER RESOLVED that construction of said structure is not detrimental to the health, safety or general welfare of the community, nor will cause serious traffic congestion or hazards, nor will seriously depreciate surrounding property, and that the same is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan; and ' r • BE IT FIIRTBER RESOLVED, that said Conditional Use Permit for Accessory Structure at 1635 Dodd Road be approved, as proposed in Case File No. 94-07, with the following conditions: 1. That the two existing buildings must be removed within 12 months of construction of the loft; and 2. That the new structure must match the existing garage; and 3. That the Conditional Use Permit is granted for the sole purpose of raising pigeons; and 4. That the structure must be kept clean and free of debris, rodents and noticeable odor; and 5. That the pigeons are to be kept on the premises and not allowed to roost elsewhere; and 6e That the pigeon noise is to be kept to minimum to avoid constituting a nuisance to surrounding land owners.
