Res 1994 - 34A Approving Variance & Building Permit for United Properties for BDS, Inc. ProjectCITY OF DlENDOTA HEIGHTS DAKOTA COIINTY, MINNESOTA RESOLIITION NO. 94 - 34�- RESOLIITION APPROVING VARIANCE AND BIIILDING PERMIT FOR UNITED PROPERTIBS FOR BDS, INC. PROJECT �BEREAS, United Properties has made application for approval of the preliminary plat for the BDS Addition and for a 20 foot sign setback variance; and DPSEREAS, the applicant has requested approval of a building permit for a 28, 600 square foot office/warehouse facility for BDS, Inc. along with a request for the issuance of tax increment financing assistance for the project in an amount not to exceed $180,000; and �HEREAS, the City Council on May 3, 1994 approved the preliminary and final plats for the BDS Addition and reviewed architectural renditions of the proposed structure and tax increment financing documentation; and D�HEREAS, in conflict with City policy that new structures in the Industrial District must be finished the same on all four sides, plans for structure did not include the same exterior materials and architectural treatment on the rear side; and wHEREAS, concern was expressed over the base estimated market value of the land proposed to be used in calculating tax increment financing; and �PHEREAS, on May 17, 1994, Council was advised that the estimated market value of the BDS land cannot be determined until such time as the plat has been filed and reviewed by the Dakota County Assessor and directed that the Tax Increment Financing Developer's Agreement address minimum improvements to be made to the land. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Mendota Heights to grant a 20 foot sign setback variance and authorize the issuance of a building permit to United Properties for construction of the BDS, Inc. office/warehouse conditioned upon identical architectural treatment on all four sides of the building, consistent with representations made to the Council at its meeting on May 17, 1994 and further subject to review and approval of the plans by the City's Code Enforcement Department; and B$ IT FIIRTH�R R$SOLVED, that the City Council of the City of Mendota Heights finds for tax increment financing purposes that the proposed development will create an increase in property value of $1 million over that existing on January 1, 1994, which is the amount of value necessary to support the requested Tax Increment Financing assistance.
