Res 1994 - 43 Approving a Wetlands Permit for a Stairway & Landscapting at 800 Havenview CtcaTx oF r�rmoTA HEic$Ts DAKOTA COUNTY, MINNESOTA RESOLIITION N0. 94- 43 A RESOLIITION APPROVING A DVETLANDS PERMIT FOR A STAIRWAY AND LANDSCAPIY�TG AT 800 HAVENVIED�I COIIRT WHEREAS, Mr. Scott Beaty, of S00 Havenview Court, has made application for a Wetlands Permit to allow construction of a Stairway and to install landscaping to within twenty five feet (25') of the wetlands, as proposed on site plans in Case File No. 94-18; and �HEREAS, the Mendota Heights Planning Commission considered said application on June 28, 1994; and �VIiEREAS, on June 28, 1994 the Planning Commission waived the required public hearing and voted unanimously (5-0) to recommend that City Council approve a Wetlands Permit to allow construction of said stairway and installation of landscaping, as proposed, with the condition that if ten percent (10�) or more of the landscaping that is installed for this project is removed, then the stairway must be removed. WHEREAS, the City Council reviewed said application for Wetlands Permit at their July 5, 1994 meeting. N0� THEREFORE IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Wetlands Permit to allow construction of a Stairway and to install landscaping to within twenty five feet (25') of the wetlands is consistent with the general welfare of the citizens of the community and the surrounding land; and �" BE IT FIIRTSER RESOLVED that construction of said structure is not detrimental to the health, safety or general welfare of the community and that the same is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan; and BE IT FURTHER RESOLVED that the proposed plans for 800 Havenview Court has the purpose and intent of reducing erosiori and to maintain the natural edge of the pond/wetlands in order to enhance the existing vegetation and wildlife; and BE IT FIIRTSER RESOLVED, that said Wetlands Permit for Stairway and Landscaping for 800 Havenview Court be approved, as proposed in Case File No. 94-18, with the following conditions: 1. That the owner agrees to maintain the landscaping in the project area in a manner consistent with the project plan on file with the City of Mendota Heights, unless otherwise agreed to in writing by the City, or the stairway must be removed; and 2, That a copy of this resolution be filed with the property title at the County Recorder's Office.
