Res 1994 - 91 Approving Vacation of Drainage & Utility EasementsCaty of Menclota Heights Dakota County, Minnesota RESOLU'�"ION NO. 94- 91 APPROVING VACATIOlV OF DItAINAGE AND UTII,ITY EASIIVIF.NTS WHF�EAS, the City of Mendota Heights is the cunent record owner of a drainage and utility easement as described as follows; and WHEREAS, the City of Mendota Heights is the cunent record owner of a drainage and utility easement as described as follows; and A permanent easement for drainage and utility purposes, said pazcels described as follows: The westerly 5.00 feet and the easterly 5.00 feet of Lot 2, Block 1, North Ivy Hills Second Addition, as platted and of record, I�akota County, Minnesota except the northerly 5.00 feet and the southerly 10.00 feet of said Lot 2, located in Section 13, Township 28 North, Range 23 West, Dakota County, Minnesota. The westerly 5.0 feet of Lot 3, Block 1, North Ivy Hills Second Addition, as platted and of record, Dakota County, Minnesota, except the northerly 5.00 feet and the southerly 10.00 feet of said Lot 3, located in Section 13, Townslup 28 North, Range 23 West, Dakota County, Minnesota. WHEREAS, a notice of heari.ng on said vacation has been duly published and posted more than two weeks before the date scheduled for the hearing on said vacation, all in accordance with the applicable Minnesota Statutes; and WHEREAS, a public hearing was held on said vacation on December 6, 1994, at 8:00 o'clock P.M., or as soon as possible thereafter, at the City Hall of the City of Mendota Heights; and WHEREAS, the City Council then proceeded to hear all persons interested in said vacation and all persons �were afforded an opportunity to present their views and objections to the granting of said petition. NOW THEREFORE, IT IS HEREBY RFSOLVED by the City Council of the City of Mendota Heights, Minnesota, as follows: 1. That the vacation of the drai.nage and utility easements described above, situated in the City of Mendota Heights, is in the best interest of the public and the City, and is not detrimental to the health, safety and welfare of the community. y � 2. That the above described drainage and utility easements be and the same is hereby vacated. � 3. That the City Clerk he and is hereby authorized and directed to prepare and present to the proper Dakota County officials a notice of completion of these vacation proceedings, all in accordance with the applicable Minnesota Statutes.
