RESOLUTION ACCEPTING ENGINEER'S REPORT, ORDERING IlVIPROVFIV�NT
AND PREPARATION OF PLANS AND SPECIFICATIONS FOR THE
RECONSTRUCTION/REHABILITATION IlVIPROVEMENTS TO SERVE
FRIENDLY HILLS REARRANGIIVIFNT, HASELBURGER ADDITION,

WHEREAS, a public hearing was held on the 6th day of December, 1994, at 7:45
o'clock P.M., or as soon as possible thereafter, and then continued to December 20, 1994, in
the City �Iall of the City of Mendota Heights, Minnesota pursuant to resolution duly adopted
by the City Council of the City of Mendota Heights on the question of the proposed
construction of the following described improvements:
The construction of street improvements consisting of the acquisition of easements and
the grading, stabilization, dra.inage and bituminous surfacing, construction of concrete
curbs and gutters and storm pipes on the street to be situated in the area hereinafter
more particularly described
WHEREAS, due publication of the notice of public hearing on said proposed
construction has been attended to; and
WHEREAS, mailed notice of said hearing has been mailed more than 10 days before
the date of said hearing to the owners of each parcel situated within the area proposed to be
assessed, all in accordance with the applicable Minnesota. Statutes, and
WHEREAS, the City Engineer reported that the proposed improvement and
construction thereof were feasible and desirable and further reported on the proposed costs of
said improvements and construction thereof; and
WHEREAS, it is in the property owner's best interest to eliminate undesirable existing
sump pump discharges to e�sting ground surfaces where ever feasible by constructing a direct
sump pump discharge connection to the proposed storm sewer system under this improvement
project; and
WHEREAS, the individual property owner derives the greatest benefit from a direct
sump pump discharge connection to the proposed storm sewer system, the individual property
owner shall be notified and encouraged to have the City construct a direct sump pump
connection at the property owner's sole cost and expense at the accepted unit price bid as
stipulated under the City's executed improvement project contract; and
WHEREAS, the area proposed to be assessed for said 'unprovements is situated within
the City of Mendota Heights in Dakota. County, Minnesota and is more particularly described
as follows:
All parcels located in Friendly Hills Re-arrangement except parcels 27-27800-010-02
and 27-27800-190-05, Haselburger Addition, Simek Rearrangement and Parcels No.
27-02500-020-52; 27-02500-021-52; 27-02500-030-52; 27-02600-012-77;
27-03600-010-26; 27-03600-020-26; 27-03600-030-26; 27-03600-010-27;
27-48225-010-00 and 27-48225-020-00.
WHEREAS, properties within the unprovement drainage azea which are not also
contiguous to a reconstxucted street, while not exempt from future assessments for subsequent
improvement projects, shall be exempt from storm sewer assessments under this project, and
whose proportionate share of the storm sewer cost will not be passed on to other benefitting
properties but shall instea.d be offset by an in-kind contribution from the City Storm Water
Utility Fund, are specifically described as follows:
Parcels No. 27-02500-010-52; 27-02500-040-52; 27-02500-050-52; 27-02600-010-78;
27-03600-010-25;27-03600-020-25;27-27800-010-02 and 27-278a0-190-05.
WHEREAS, the City Council then proceeded to hear all persons interested in said
improvement and all persons were afforded an opportunity to present their views and
objections to the maki.ng of said improvements.
NOW THEREFORE, IT IS HEREBY ItESOLVED by the City Council of the City
of Mendota Heights, Minnesota. as follows:
1. That the feasibility report prepared by the City Engineer is hereby accepted.
2. That it is advisable, feasible, expedient and necessary that the City of Mendota
Heights construct the above described improvements, and it is hereby ordered
that said improvement be made.
3. That the City Engineer be and he is hereby authorized and directed to prepare
plans and specifications for said improvement.
4. That said improvement shall hereafter be known and designated as Improvement
No. 92, Project No. 6.
Adopted by the City Council of the City of Mendota Heights this 20th day of December,
1994.
