Res 1995 - 46 Approving a Conditional Use Permit, Variances & Critical Area Review Allowing a Garage, Pool & Pool House to be Constructed at 1010 Sibley Memorial Hwy (Planning Case No. 95-13)CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 95 � 46' t.� A RESOLUTION APPROVING A CONDITIONAL USE PERMIT, VARIANCES AND CRITICAL AREA REVIEW ALLOWING A GARAGE, POOL AND POOL HOUSE TO BE CONSTRUCTED AT 1010 SIBLEY MEMORIAL HIGHWAY (PLANNING CASE NO. 95-13) WHEREAS, Mr. Alden Landreville, of 1010 Sibley Memorial Highway, has made application for a Critical Area Review for a Modified Site Plan, a Conditional Use Permit for Accessory Structure to allow construction of a pool and a pool house and for a Variance to Section 7.2(10) to allow a second garage, said garage proposed to be 728 square feet, and a Variance to Section 4.5(4) to allow the garage to be located nearer the front lot line than the principal structure; and WHEREAS, the Mendota Heights Planning Commission conducted a public hearing on July 25,.1995 and August 22, 1995; and WHEREAS, based upon the public record transcribed at said public hearings, the Mendota Heights Planning Commission voted unanimously (5-0) to recommend to the Mendota Heights City Council that the Critical Area Modified Site Plan and a Conditional Use Permit for Accessory Structure be approved, to allow construction of a pool and pool house as proposed on Plans in Case File No. 95-15; and WHEREAS, based upon the public record transcribed at said public hearings, the Mendota Heights Planning Commission voted (4-1) to recommend that the City Council grant Variances to Section 7.2(10) and Section 4.5(4) to allow second garage, proposed to be 728 square feet that would be located nearer the front line than the principal structure, as proposed on plans dated 8-14-95. WHEREAS, the City Council considered said applications for Critical Area Review, Conditional Use Permit for Accessory Structure and Variances at their meeting on September 5, 1995. NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that the proposed Critical Area Review, Conditional Use Permit for Accessory Structure and Variances will have no adverse effect on the health, safety and general welfare of the citizens of the community and the surrounding land and that said proposed garage, pool and pool house is not adverse to the general purpose and intent of the Critical Area Overlay Ordinance and Zoning Ordinance. . BE IT FURTHER RESOLVED that the City Councii of the City of Mendota Heights finds that this single family property is unique in that it is five acres in size, is screened from the neighbors and the proposed structures will not alter the character of the neighborhood. BE IT FURTHER RESOLVED that the Critical Area Modified Site Plan, Conditional Use Permit for Accessory Structure to allow construction of aid pool and pool house and a Variance to Section 7.2(10) to allow a second garage, said garage to be 728 square feet, and Variance to Section 4.5(4) to allow the garage to be located nearer to the front line than the principal structure be approved to allow Mr. Alden Landreville to construct a garage, pool and pool house, as proposed on the plans on file in Case No. 95-13 with the following conditions: 1. That a silt fence be installed prior to the commencement of the pool and pool house construction and be left in place until the soil has been reestablished. 2. That a revised set of plans, show the silt fence, be submitted prior to receiving a building permit. �� 3. Any attempt to subdivide the property will automatically terminate the variances with respect to the garage.
