WHEREAS, Ms. Janice Simmonds has made application for a Conditional
Use Permit for Fiil to piace approximateiy 940 cubic yards of fill on fJutlot A,
Evergreen Knolls Addition in order to canstruct a new single family home at an
elevation h�gh enough to be served 6y City sanitary sewer located at the
intersection of Evergreen Knoll and Wachtler Avenue; and
WHEREAS, the Mendota Heights Planning Commission conducted a public
hearing on August 22, '1995 to cansider said application; and
WHEREAS, based upon the pu6lic record transcribed at said public hearings,
the Mendota Heights Planning Commission voted (5-0) to recommend to the
Mendata Neights Ciiy Councii that the above described Conditional Use Permit for
Fil! be approved subjec# to the following conditions: ,
1, That turf establishment specifications be added to the �inal Plan.
2. That an addifional silt fence be included along the sastern property
line acrass the swate to golf course. �
3. That the driveway turnaround be reviewed by the Fire Marshal and
include a#ive foot {5'} setback to the property tine.
4. �That atl dump truck spiltage be cleaned promptly at the cost of the
developer.
5. That ten foat (10') utility easements around the property perimeter be
provided to the City.
fi. That all dump truck access to the site be fram Wachtter Avenue and
not Evergreen Knolls.

WHEREAS, the City Council considered said application for Conditiona! Use
Permit for Fitl at their meeting on September 5, 1995.
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the City :'� �
of Mendota Heights that the proposed Conditional Use Permit for Fill wiil have no �' �
adverse effect on the health, safety and general welfare of the citizens of the
community and the surrounding land and that said proposed 900 cubic yards of fill
is not adverse to the general purpose and intent of the Zoning Ordinance.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that said Conditional Use Permit for Fill be approved subject to the
following conditions:
1. That turf establishment specifications be added to the Final Plan.
2. That an additional silt fence be included along the eastern property
line across the swale to golf course.
3. That the driveway turnaround be reviewed by the Fire Marshal and
include a five foot (5') setback to the property line.
4. That all dump truck spillage be cleaned promptly at the cost of the
developer.
5. That ten foot (10') utility easements around the property perimeter be --
provided to the City. �, �
