RESOLUTION APPROVING VARIANCES ALLOWING
ADDITIONS TO A SINGLE FAMII.Y RESIDENCE
W�iF.REAS, James B. Sargeant and Beverly K. Sargeant (collectively, the "Applicants") have
applied to the City of Mendota Heights (the "City") for a variance relating to the construction
of improvements at that certain property located at 1040 Sibley Memorial Highway and more
particulazly described as Lot 1, Mayfield Heights, Dakota County, Minnesota (the "Site");
WHEREAS, the City Council deems that there is a practical difficulty in designing
improvements to the single family residence at the Site due to steep slopes and the placement
of the existing single family residence on the Site;
WHEREAS, the City Council deems that the site plan submitted by the Applicants (the "Site
Plan") shows that the proposed improvements are at the most reasonable location, considering
the nature of the Site and the unique angle of the e3cisting single family residence to the front
lot line of the Site;
WHF.REAS, the City Council deems that the proposed improvement would minimize the impact
on the sloping and wooded nature of the Site by reducing the amount of grading and tree
removal necessary for such improvements; and
WHEREAS, the City Council deems that the steep slopes and step design of the Site Plan, along
with a tuck under garage beneath the living space, creates a practical difficulty in (a) meeting
the height requirements of the Rl zoning district and (b) keeping the design of the single family
residence compact to minimize the impact on the sloping and wooded nature of the Site.
NOW, 1'HEREFORE, be it hereby resolved that the City Council of the City of Mendota
Heights hereby grants the following variances with respect to the Site, subject to the following
conditions:
1. Variances.
a. A 6.62 front yard set back variance allowing the proposed improvements to be
set back 23.38 feet from the right-of-way of Mayfield Iieights Road, instead of
the required 30 feet set back.
b. A 10.5 feet height variance allowing the proposed improvements to be 35.5 feet
in height instead of the required 25 feet height limitation.

The current foundation footprint and the height of the single family residence at
the Site may not be increased, except in accordance with the Site Plan.
The garage currently existing at the Site must be removed and the rear yard at the
Site must be restored prior to September 1, 1996.
The driveway at the Site shall be moved to the south so that its slope will not
exceed a 3 % grade.
