POLICY TO PROVIDE CITY WATER SERVICE TO SERVE PROPERTIES
ABUTTING WENTWORTH AVENUE
(IlVIPROVIIVIENT NO. 95-4, PROJECT NO. 9611)
WHEREAS, a public hearing was held on 7anuary 16, 1996 at 8:00 o'clock P.M. in
the City Hall of the City of Mendota Heights, Mi.nnesota pursuant to resolution duly adopted
by the City Council of the City of Mendota Heights on the question of the proposed
construction of the following described improvements:
The construction of an extension to the City's water distribution system including
appurtenances arid incidentals thereto, and the acquisition of easements, and the
reconstruction where necessary of streets and easements in the area hereinafter more
particularly described.
WHEREAS, due publication of the notice of public hearing on said proposed
construction has been attended to; and
WHEREAS, mailed notice of said heari.ng was mailed more than ten (10) days before
the date of said heari.ng to the owners of each pazcel situated within the area proposed to be
assessed, all in accordance with the applicable Minnesota Statutes; and
WHEREAS, the City Engineer reported that the proposed improvement and
construction thereof were feasible and desirable and further reported on the proposed costs of
said improvements and construction thereof; and
WHEREAS, the area proposed to have been assessed for said improvements is situated
withi.n the City of Mendota Heights in Dakota County, Minnesota and is more particularly
described as follows:
Foxwood, Hidden Meadow, portions of Wallner-Joyce Estate and adjacent lots along
Wentworth Avenue between Delaware Avenue and Dodd Road.
WHEREAS, the proposed per lot assessments which were presented at the public
hearing were determined to have exceeded the economic benefit to the individual properties as
determined by a subsequent appraisal report; and
WHEREAS, Council has subsequently decided that all proposed assessments be
canceled for water service connections which could be provided to the properties noticed
during the public heari.ng; and
WHEREAS, The Council has determined that it is in everyone's best interest to
construct residential water service connections at this time so that water service is available
with minimal disruption to these residential properties in the future if requested.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights, Minnesota as follows:
1. That the City cancel the proposed assessments against the progerties noticed
previously for any of the costs associated with this improvement project.
2. That, prior to the issuance of a City building, or St. Paul Water (SPV� service
connection germit, the City impose a connection charge, separate from any
actual SPW connection costs, for each residential water connection served from
the Wentworth Avenue Trunk Watermain.
3. That the water service connection charge be calculated based on the then current
water assessment in comparable developments.
Adopted by the City Council of the City of Mendota Heights this 21st day of May,
1996.
