Res 1996 - 51 Approving a Conditional Use Permit for Land Reclamation, Wetland Permit, & a Tree Removal Permit to Faster Enterprises` CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 96-51 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR�.AND RECLAMATTON, A WETLAND PERMIT, AND A TREE : REMOVAL PERMTT TO PASTER ENTERPRISES WHEREAS, Mr. Streeter of Paster Enterprises has requested a Conditional Use Pernut for Mining as proposed on plans in Case File No. 96-22; and WHEREAS, The Planning Commission of the City of Mendota Heights conducted the required public hearing to review this application at their July 23, 1996 meeting; and WHEREAS, The Planning Commission voted 5-0 (with two members absent) to recommend that the City Council approve this request, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that at Conditional Use Permit for Land Reclamation, a Wetland Permit for fill no closer than 60' to the ditch, and a Tree Removal Permit to Paster Enterprises as proposed on plans in Planning Case No. 96-23 are hereby granted under the following conditions: 1. The City of Mendota Heights preserves all of its right-of-way rights on these properties, equivalent to a"blanket easement" over the entirety of the parcels, in '�.. anticipation that it may wish to construct or extend a road on this property sometime in the future. 2. The entire disturbed area must be seeded. 3. Paster Enterprises must take all appropriate Erosion Control measures 4. Paster Enterprises must implement the Weir Correction measures proposed by both its own Hydrologist Do�,iglas and the City's Engineer Mogan as submitted to the Council on August 6, 1996, all at no cost to the City. 5. The sedimentation pond and its environs must be maintained by Paster Enterprises at no cost to the City. 6. This Land Reclamation Permit, Wetland Pernut, and Tree Removal Pernut do not -- constitute implicit or explicit approval of any development on this land. 7. Paster Enterprises shall cut down no more than 20 trees of 4" or greater diameter. � ` 8. The entire project, including all conditions, must be completed by midnight on September 30, 1996.
