RESOLUTION NO. 96-�2
A RESOLUTION APPROVING CONDITIONAL USE PERMITS
FOR AN ESSENTIAL SERVICE AND NIINING, AND A VARIANCE
FOR A FENCE HIGHER THAN SIX FEET WITH BARBED WIRE
FOR NORTHERN STATES POWER AT THE ROGERS LAKE SUBSTATION
WHEREAS, NSP has requested Conditional Use Pernuts for Mining and
Essential Services, and a Variance for a fence higher than six feet with barbed wire as
proposed on plans on file in Planning Case No. 96-18; and
WHEREAS, The Planning Commission of the City of Mendota Heights held a
public hearing on this application at their May 28 and 7une 25, 1996, meetings; and
WHEREAS, The Planning Commission voted 5-0 (with two members absent) on
June 25, 1996 to recommend that the City Council approve this request,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that Conditional Use Permits for Mining and Essential Services,
and a Variance for a fence higher than six feet with barbed wire are hereby granted
conditioned upon the following:
that NSP comply with their landscape plan showing the extension of the west wa1160
feet, the planting of trees between the walkway and the substation, the extension of the
berm north of the substation, the planting of Arborvitae on the east side, and the
planting of trees on the north side, as shown on plans on file in Planning Case No. 96-
18,
2. that if any damage be done to the e�sting landscaping it be replaced by NSP,
3. that NSP attach a 4' wide noise barrier atop the northeast retaining wa11s made of
sound-absorbing material as proposed by and agreed to by NSP at the City Council
meeting on August 20, 1996,
4. that NSP modify the support structure of the capacitor banks by adding pipes filled
with grout to reduce noise as agreed to by NSP at the City Council meeting on August
20, 1996,
5. that NSP shall install a sound absorbing noise barrier immediately north of the existing
#1 and #2 transformers and approximately 120 feet long according to the plan

presented by NSP at the meeting, a copy of which has been placed in Planning Case
File # 96-18 and dated August 20, 1996,

6. that NSP take the same noise measurements 30 days after the project is completed
which it has already taken and submitted to the City, and present this information to
the Council within 30 days after they are taken,
7. and that if the above measurements indicate that the noise has increased in volume at
any of the measuring points on the premises of local residents, NSP present to the City
and agree to implement a remediation plan.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that the proposed Conditional Use Pernuts for Mining and Essential Services, and
a Variance for a fence higher than six feet with barbed wire as proposed on plans on file in
Planning Case No. 96-18 under the conditions stipulated above will have no adverse
impact on the health, safety and general welfare of the citizens of the community and the
surrounding land and that said proposed substation improvements are not adverse to the
general purpose and intent of the Zoning Ordinance.
Adopted by the City Council of the City of Mendota=Heights this 20th day of August,
1996.
