Res 1996 - 66 Allowing a Lot Division at 610 Callahan PlaceCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 96-66 A RESOLUTION ALLOWING A LOT DIVISION AT 610 CALLAHAN PLACE. WHEREAS, Mr. Pirkl has requested permission to subdivide his lot at 610 Callahan Place as proposed on plans on file in Planning Case No. 96-28; and WHEREAS, The Planning Commission of the City of Mendota Heights discussed this application at their August 27 meeting; and WHEREAS, The Planning Commission voted 5-1 (with one member absent) on August 27, 1996 to recommend that the City Council approve this request, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a lot division is hereby granted to Mr. Pirkl for 610 Callahan Place under the following conditions: 1. The applicant shall bring the existing driveway into conformance with City code by removing a sufficient portion of the bituminous surface to adhere to the 5 foot setback requirement when the applicant reorients the driveway. 2. The City Council has also hereby authorized our Code Enforcement Officers to grant a driveway permit to the applicant for the new lot "B", although this driveway permit does not establish any building setback from the extended Warrior Drive Right-of- Way. 3. This granting of a lot division provides no assurance that the unopened Warrior Drive dedicated Right-of-Way will be vacated in the future. 4. This granting of a lot division does not imply approval of any further division of these lots. 5. This granting of a lot division does not imply approval of any setback vaxiances or other variances when a house is built on the property. Any setback variances this applicant or a future applicant may require for a new home sha11 be considered to be induced by self-created hardships from this lot division. 6. The City has taken it on faith that the applicant has, as was represented in the letter of intent accompanying the application, presented to his neighbors the Foxes (at 1851 Warrior Drive) the proposed location of the new home. 7. Payment of the $750 Park Dedication Fee will be due upon receiving a permit from the Code Enforcement Officers. 8. The applicant is also hereby informed that this newly created lot has not paid assessments to be allowed to connect to the City's sewer and water and that the appropriate connection charge will be required at the time of building permit application. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that the proposed Lot Division as proposed on plans on file in Planning Case No. 96-28 under the conditions stated above will have no adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land and that said proposed Lot Division is not adverse to the general purpose and intent of the Zoning Ordinance.
