RESOLUTION NO. 96- 82
A RESOLUTION FOR A WETLANDS PERMIT FOR
2464 BRIDGEVIEW COURT FOR THE CONSTRUCTION
OF A REAR-YARD POOL AND ACCOMPANYING STRUCTURES
WHEREAS, Mr. Scott Bachman has requested a Wetlands Permit for the construction of
a rear-yard pool, spa, fence, pool storage building, filters, and heaters, and to remove
approximately 100 cubic yards of soil at 2464 Bridgeview Court to within 45' of the designated
wetlands as proposed on plans in Planning Case File No. 96-30; and
WHEREAS, Mr. Bachman has obtained all necessary signatures of consent from the
appropriate neighbors, and thus the Plannuig Commission of the City of Mendota. Heights chose to
waive the public hearing on this application at their September 24, 1996, meeting; and
WHEREAS, The Planning Commission voted 6-0 (with one member absent) on
September 24, 1996 to recommend that the City Council approve this Wetlands Pernut for a pool,
spa, fence, paol storage building, filters and heaters, and to remove approximately 100 cubic yards
of soil to within 45' of the designated wetlands; and
WHEREAS, the Council has deternuned that there is significant precedent for similar
Wetlands Pernuts being granted for other properties within the Bridgeview Shores First Addition.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota. Heights that the application for Wetlands Permit for a rear-yard pool, spa, fence, pool
storage building, filters, and heaters, and to remove appro�imately 100 cubic yazds of soil to
within 45' of the designated wetlands at 2464 Bridgeview Court as proposed on plans on file in
Planning Case File No. 96-30 be approved.
BE IT FIJRTHER RESOLVED by the City Council of the City of Mendota, Heights that
the Wetlands Permit for a rear-yard pool, spa, fence, pool storage building, filters and heaters, and
to remove approximately 100 cubic yards of soil to within 45' of the designated wetlands at 2464
Bridgeview Court as proposed on plans on file in Planning Case No. 96-30 will not have an
adverse impact on the health, safety or general welfare of the citizens of the community and the
sunounding land, and will not be adverse to the general purpose and intent of the Zoning
Ordinance.
