Res 1998 - 06 Approving a Subdivision at 636 South Freeway RoadCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 98-06 A RESOLUTION APPROVING A SUBDIVISION AT 636 SOUTH FREEWAY ROAD WHEREAS, Ms. Emily Comb of 636 South Freeway Road (Lot 1, Block 4, Jefferson Heights, Dakota County, Minnesota) has applied for a subdivision as proposed on plans on file in Planning Case No. 98-01; and WHEREAS, The Planning Commission of the City of Mendota Heights held a public hearing on this application at their January 23, 1998 meeting; and WHEREAS, The Planning Commission voted 7-0 on January 23, 1998 to recommend that the City Council approve this application under the conditions enumerated below; and WHEREAS, The City Council discussed this application at their regular meeting on February 3, 1998, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a subdivision of 636 South Freeway Road (Lot 1, Block 4, Jefferson Heights, Dakota County, Minnesota) into two lots referred to respectively on the survey submitted by the applicant as "Lot 1, Block 4, Jefferson Heights, Dakota County, Minnesota, except the southerly 160 feet thereof' and "The southerly 160 feet of Lot 1, Block 4, Jefferson Heights, Dakota County, Minnesota", and as proposed on plans on file in Planning Case No. 98- 01, is hereby granted subject to the following conditions: 1. The Applicant shall, prior to filing the new plat with Dakota County, completely remove the accessory structure in the southern part of the existing lot, including any foundation thereto. 2. The purchaser of the new lot created shall save all significant trees in the construction of the new house. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this approved subdivision as proposed on plans on file in Planning Case No. 98-01 under the above conditions would not have an adverse impact on the health, safety or general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
