Res 1998 - 12 Approving a 3-Foot Height Variance & an Opacity Variance for a Fence at 2246 Fieldstone DriveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 98-12 A RESOLUTION APPROVING A THREE FOOT HEIGHT VARIANCE AND AN OPACITY VARIANCE FOR A FENCE AT 2246 FIELDSTONE DRIVE WHEREAS, Kim and John Park of 2246 Fieldstone Drive have applied for a three foot height variance and an opacity variance for a fence as proposed on plans on file in Planning Case No. 97-41; and WHEREAS, The Planning Commission of the City of Mendota Heights held a public hearing on this application at their January 23, 1998 meeting; and WHEREAS, The Planning Commission voted 6-0 on January 23, 1998 (with one Commissioner abstaining) to recommend that the City Council approve this application; and WHEREAS, The City Council discussed this application at their regular meeting on February 3, 1998, and again on February 17, 1998, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a three foot height variance and an opacity variance for a fence at 2246 Fieldstone Drive as proposed on plans on file in Planning Case No. 97-41 is hereby approved on the following conditions: 1. that the side of the fence considered to be the face (the side opposite the post) shall face Delaware Avenue 2. that the fence shall be located entirely on the Parks' property 3. that the fence extend south from the existing fence and match in materials and color 4. that after construction of the fence, the applicant screen the entire length of the fence with natural -appearing vegetation. BE IT FURTHER RESOLVED that the need for these variances under the above conditions derives in part from the following considerations: 1. The uniqueness of the property in topography and vegetation 2. The security concerns regarding possible access to the property from Delaware 3. The safety concerns regarding children using the property as a shortcut to Delaware BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that these approved variances as proposed on plans on file in Planning Case No. 97-41 would not have an adverse impact on the health, safety or general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
