RESOLUTION NO. 98 -4
A RESOLUTION APPROVING A 20 -FOOT SETBACK VARIANCE TO A SIDE YARD
ABUTTING A STREET FOR 1334 SYLVANDALE ROAD FOR A GARAGE ADDITION
WHEREAS, Mr. Jack Vitelli of 1334 Sylvandale Road (Lot 3, Block 8, Ivy Falls Second
Addition) has requested a 20 -foot setback variance to a side yard abutting a street for a garage
addition to within 10 feet of the property line abutting Emerson Avenue, and
WHEREAS, this parcel (Lot 3, Block 8, Ivy Falls Second Addition) had already received
a 20' set back variance to a side yard abutting a street to build to within 10 feet of the property line
abutting Emerson Avenue on September 18, 1979, and;
WHEREAS, the City of Mendota Heights vacated the northern 17.5 feet of Emerson
Avenue adjacent to Lot 3, Block 8, Ivy Falls Second Addition for the entire length of the southern
lot line of Lot 3, Block 8, Ivy Falls Second Addition for accrual to Lot 3, Block 8, Ivy Falls
Second Addition, on the condition that a drainage and utility easement be retained by the City for
the southern 7.5 feet of said vacation on April 21, 1998,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights that a 20 -foot set back variance to a side yard abutting a street for a garage
addition is hereby approved.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that
said variance does not have an adverse impact on the health, safety or general welfare of the
citizens of the community and the surrounding land, and is not adverse to the general purpose and
intent of the Zoning Ordinance.
