RESOLUTION 98- 34
A RESOLUTION DENYING A CONDITIONAL USE PERMIT FOR A HOTEL
AND A WETLANDS PERMIT FOR A HOTEL AT CENTRE POINTE
WHEREAS, Mr. Henry Votel has applied for a Conditional Use Permit and a
Wetlands Permit for a Best Western Hotel at Centre Pointe as proposed on plans on file in
Planning Case No. 98-14; and
WHEREAS, in connection with such permit applications, the applicant has
requested that the City of Mendota Heights vacate a portion of a public drainage
easement, located on the subject property; and
WHEREAS, The Planning Commission of the City of Mendota Heights discussed
this application at their regular meeting on May 26, 1998; and
WHEREAS, The Planning Commission held a public hearing on this application at
their May 26, 1998 meeting; and
WHEREAS, The City Council discussed this application at their June 2, 1998
meeting,
NOW, THEREFORE, IT IS HEREBY RESOLVED that the City of Mendota
Heights makes the following Findings of Fact:
1. The proposed hotel is three stories high and therefore out of character with the
surrounding structures.
2. The magnitude of the proposed hotel structure is out of character with the
neighborhood and the lot coverage of structures on surrounding properties
3. The proposed hotel structure is a 24-hour operation and therefore out of character
with the surrounding establishments.
4. The extent of the proposed signage significantly exceeds the scope of signage of
neighboring commercial properties.
5. The City does not find it to be in the public interest to wholly or partially vacate the
drainage easement on the site or to modify its property rights on the site at this time.
6. Given its proximity to residential areas, along with its proposed size, magnitude and
traffic volume, the proposed development may be detrimental to nearby residences for
reasons which include increases in the frequency of traffic lights from cars entering and
exiting the property shining into the windows of nearby residences.
7. The lack of emergency vehicle access to the rear of the proposed building creates
potential safety problems as expressed in the May 29, 1998 memo to the City Council
from the Chief of the Mendota Heights Fire Department.
8. There is strong neighborhood opposition to this proposed development, based upon,
among other factors, the findings of fact noted above.
9. Based upon the above findings of fact, the granting of this Conditional Use Permit and
Wetlands Permit for a Best Western Hotel at Centre Pointe as proposed on plans on
file in Planning Case No. 98-14 would have had an adverse impact on the health,
safety and general welfare of the citizens of the community and the surrounding land.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that based upon the above Findings of Fact a Conditional Use Permit and a
Wetlands Permit for a Best Western Hotel at Centre Pointe as proposed on plans on file in
Planning Case No. 98-14 is hereby denied.
