RESOLUTION 98-
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A
SINGLE FAMILY HOME ON OUTLOT B, BLOCK 1, MENDOTA WOODS
WHEREAS, Mr. Terry Wensmann has applied for a Conditional Use Permit, for
a single family home on Outlot B, Block 1, Mendota Woods as proposed on plans on file
in Planning Case File No. 98-20; and
WHEREAS, The Planning Commission of the City of Mendota Heights discussed
this application at their regular meeting on June 23, 1998; and
WHEREAS, The Planning Commission held a public hearing on this application at
their June 23, 1998 meeting; and
WHEREAS, The Planning Commission voted 6-0 on June 3, 1998 to recommend
that the City Council approve the Conditional Use Permit, under the condition that the
land not be further subdivided in the future,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit for a single-family home at Outlot
B, Block 1, Mendota Woods as proposed on plans on file in Planning Case No. 98-20 is
hereby approved under the following conditions
1. that the land not be further subdivided in the future.
2. that the applicant enter an Access Easement Agreement with the Kensington Manor
Homes Condominium Association.
3. that the City make a finding that the proposed house does not constitute a three-story
house, but rather a two-story "reverse walkout" house.
4. that the access drive from the cul-de-sac be a minimum of 20 feet wide, or a minimum
of 16 feet wide with the installation of a residential sprinlder system.
5. that the area immediately adjacent to the house provide a sufficient vehicle turn-
around area to the satisfaction of the Fire Chief.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this approved Conditional Use Permit for a single family home at Outlot B,
Block 1, Mendota Woods as proposed on plans on file in Planning Case No. 98-20 under
the above conditions would not have an adverse impact on the health, safety and general
welfare of the citizens of the community and the surrounding land, and would not be
adverse to the general purpose and intent of the Zoning Ordinance.
