Res 1998 - 49 Approving a Conditional Use Permit & a Variance for Detached Garage at 2227 Dodd RoadCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 98-49 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND A VARIANCE FOR A DETACHED GARAGE AT 2227 DODD ROAD WHEREAS, Mr. Richard L. Staples has applied for a Conditional Use Permit and a Variance for a detached garage as proposed on plans on file in Planning Case No. 98-18; and WHEREAS, The Planning Commission of the City of Mendota Heights discussed this application at their regular meeting on June 23, 1998; and WHEREAS, The Planning Commission held a public hearing on this application at their June 23, 1998 meeting; and WHEREAS, The Planning Commission voted 6-0 on June 23, 1998 to recommend that the City Council approve this application under the condition that Mr. Staples close his existing attached garage, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit and a variance for a detached garage as proposed on plans on file in Planning Case No. 98-18 is hereby approved with the owner's consent under the following conditions: 1. that the applicant post a bond of $1000 to the City of Mendota Heights, to be returned upon removal of the attached garage within one year of adoption of this Resolution 2. that the detached garage be no greater than 960 square feet in size and shall have no more than one single 16' by 8' garage door. 3. that no use be allowed in the garage other than private residential non-commercial use. 4. that the new garage and the house match each other with siding as proposed by the applicant. 5. that the applicant shall be responsible for maintaining screening between the garage and neighboring properties. 6. that the Conditional Use Permit shall be rescinded in the future if this lot is subdivided 7. that no further vehicle storage shall be allowed in the existing attached garage starting from the date of completion of the detached garage or within one year of the date of passage of this Resolution, whichever is sooner 8. that violation of any of the above shall automatically terminate cause this Conditional Use Permit. BE IT FURTHER RESOLVED that the City finds this Conditional Use Permit and Variance to be appropriate due in part to the fact that the subject property is over one acre in size. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this approved Conditional Use Permit and variance for a detached garage as proposed on plans on file in Planning Case No. 98-18 under the above conditions would not have an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
