Res 1998 - 50 Approving a Conditional Use Permit & Variances for a Detached Garage at 995 Delaware AvenueCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 98-5il . A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND VARIANCES FOR A DETACHED GARAGE AT 995 DELAWARE AVENUE WHEREAS, Mr. Mark Homer has applied for a Conditional Use Permit and Variances for a detached garage at 995 Delaware Avenue as proposed on plans on file in Planning Case No. 98-23; and WHEREAS, The Planning Commission of the City of Mendota Heights discussed this application at their regular meeting on July 28, 1998; and WHEREAS, The Planning Commission held a public hearing on this application at their July 28, 1998 meeting; and WHEREAS, The Planning Commission voted 4-0 on July 28, 1998 to recommend that the City Council approve this application under certain conditions, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit for a detached garage 528 square feet in size and 85 feet from the east lot line and both an eight foot side yard setback variance for the garage and a three foot side yard setback variance for the driveway for each to be two feet from the side property line, as proposed on plans on file in Planning Case No. 98-23 are hereby approved on the following conditions: 1. That the pitch of the garage roof be 10/12 2. That the garage doors be limited to only two 8' x 8' doors on the east and one 7' by 8' door on the west 3. That the materials for the garage complement the existing home 4. That the applicant submit a revised set of drawings reflecting this Resolution BE IT FURTHER RESOLVED that the Council finds this proposed garage to be consistent with other properties in the immediate vicinity of the home. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this approved Conditional Use Permit and variances for a detached garage as proposed on plans on file in Planning Case No. 98-23 under the above conditions would not have an adverse impact 011 the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent ofthe Zoning Ordinance.
