RESOLUTION 98-52
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
FOR THE LEE EDUCATION CENTER AT MENDOTA PLAZA
WHEREAS, Mr. James Lee, Director of Lee Educational Services, has proposed the Lee
Education Center at Mendota Plaza; and
WHEREAS, The Council has decided to allow this use at Mendota Plaza for one year on
an experimental basis under certain conditions,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights that a Conditional Use Permit for the Lee Education Center at Mendota Plaza
as proposed to the Council by Mr. Lee on documents submitted for the July 21, 1998 and August
4, 1998 meetings of the Council is hereby approved under the following conditions:
1. That the Conditional Use Permit expire one year from the date of adoption of this Resolution
and can only be renewed with prior consent of the Council, which shall have full discretion in
adding to, deleting, or modifying any ofthe Conditions contained herein or declining to renew
the Conditional Use Permit entirely.
2. That the Lee Education Center shall occupy the area of Mendota Plaza between Snyders Drug
Store and Mendota Liquor specified in the materials submitted to the City Council by Mr. Lee
for their July 21, 1998 and August 4, 1998 meetings. The Lee Education Center shall neither
expand at said location nor move to a different location within the mall without prior consent
of the City Council.
3. For all students at the center age fifteen and younger, a minimum of one adult per six students
shall be present at the Lee Education Center at all times. "Adult" in this context shall mean
either an adult employee or volunteer of the Lee Education Center.
4. The applicant, Mr. Lee, has agreed that one of the conditions for an extension of the
Conditional Use Permit beyond the first year shall be the installation of a second bathroom.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that
this approved Conditional Use Permit will not have an adverse impact on the health, safety and
general welfare of the citizens of the community and the surrounding land, and would not be
adverse to the general purpose and intent of the Zoning Ordinance.
