Res 1998 - 55 Approving a 1-Foot Height Variance for a 4-Foot High Fence at 1957 Walsh LaneCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 98- 55 A RESOLUTION APPROVING A ONE FOOT HEIGHT VARIANCE FOR A FOUR FOOT HIGH FENCE AT 1957 WALSH LANE WHEREAS, Ms. Susan Gagnier of 1957 Walsh Lane, has applied for a one foot height variance for a four foot high fence, as proposed on plans on file in Planning Case File Number 98-24 and as presented to the Council on the evening of August 18, 1998; and WHEREAS, The Planning Commission, at their regular meeting on July 28, 1998, was unable to come to a recommendation to the City Council on this matter, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a one foot height variance for a four foot high fence at 1957 Walsh Lane, as proposed on plans on file in Planning Case File Number 98-24 and as presented to the Council on the evening of August 18, 1998, is hereby granted subject to the following condition: 1. That the new fence adhere to the City's Zoning Ordinance in regards to opacity (Section 4.8(1)d.) BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this one foot height variance for a four foot high fence at 1957 Walsh Lane, as proposed on plans on file in Planning Case File Number 98-24 and as presented to the Council on the evening of August 18, 1998, under the above condition would have no adverse impact on the health, safety or general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
