A RESOLUTION APPROVING AN FOUR FOOT SIDE YARD SETBACK VARIANCE
FOR A GARAGE WITH SECOND STORY LIVING SPACE AND A THREE FOOT
SIDE YARD SETBACK VARIANCE FOR A DRIVEWAY AT 1191 DODD ROAD
UNDER CERTAIN CONDITIONS
WHEREAS, Mr. Gary St. John has applied for a four foot side yard setback variance for
an attached garage with living space on the second floor and a three foot side yard setback variance
for a driveway, as proposed on plans on file in Planning Case No. 98-31; and
WHEREAS, The Planning Commission of the City of Mendota. Heights discussed this
application at their regular meeting on August 25, 1998; and
WHEREAS, The Planning Commission held a public hearing on this application at their
August 25, 1998 meeting; and
WHEREAS, The Planning Commission voted 6-0 on August 25, 1998 (with one member
absent) to recommend tha.t the City Council approve this application under certain conditions,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota. Heights that four foot side yard setback variance for an atta.ched garage with living
space on the second floor and a three foot side yard setback variance for a driveway, as proposed
on plans on file in Planning Case No. 98-31 is hereby approved under the following conditions:
1. that the St. Johns obtain an official survey
2. that the St. Johns add screening of the garage as indicated to Council on September 1, 1998.
BE IT FiJRTHER RESOLVED by the City Council ofthe City of Mendota Heights that
this approved four faot side yard setback variance for an attached garage with living space on the
second floor and a three foot side yard setback variance for a driveway, as proposed on plans on
file in Planning Case No. 98-31 is necessary to alleviate a hardship because the lot line has moved,
is an improvement due to the removal of an encroaclunent on a neighboring lot, and is necessary to
bring the house into compliance with the requirement to have an attached garage with a minimum
size of 440 square feet, and would not have an adverse impact on the health, safety and general
welfare of the citizens of the community and the sunounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
