RESOLUTION ADOPTING AND CONFIRMING ASSESSMENrS
FOR STREET RECONSTRUCTION TO SERVE THE AREA REFERRED TO A5
BUNKER HII.LS INCLUDING PROPERI'IES IN RIDGEWOOD PARK,
SPRING CREEK ACRES, SOMERSET HII.LS, SOMN��RSET HII,LS NO. 2,
SUNIlV�RSET PLACE, AND VALLEY CURVE ESTATES

BE IT RESOLVED by the City Council of the City of Mendota Heights as follows:
WHEREAS, the City Clerk, with the assistance of the City Engi.neer, has calculated the
proper amount to be specially assessed for the costs incurred to date with respect to Improvement
No. 96, Project No. 3 construction of 5treet Reconstruction/Rehabilitation improvements to serve
the following property situated in the City of Mendota Heights, Dakota County, Minnesota, more
particularly described as follows:
Those parcels within Ridgewaad Park, Somerset FIills, Sommerset Hills No. 2,
Summerset Place, Spring Creek Acres, and Valley Curve Estates abutting Arvin Drive,
Hilltop Court, Hilltop Road, Ridge Place, Wachtler Avenue, Willow Lane, Valley Curve, and
the gravel a11ey between Willow Lane and Hilltop Road west of Dodd Road.
WHEREAS, the proposed assessment roll has heen on file with the Clerk and at all times
since its filing has been open for public inspection; and notice thereof has been duly published
and mailed as required by law. Said notice stated the date, time and place of such meeting; the
general nature of the improvement; the area proposed to be assessed; that the proposed
assessment roll has been on file with the Clerk; and that written or oral objections thereto by any
property owner would be considered; and
WHEREAS, said hearing was held at 8:00 o'clock P.M. or as soon as possible thereafter,
on T�esday, October 6, 1998 at City Hall in the City of Mendota Heights, Minnesota; and
WHEREAS, the Mayor announced that the hearing was open for the consideration of
objections, if any, to said proposed assessments; and
WHEREAS, all gersons present were then given an opporlunity to present oral
objections, and all written objections theretofore filed with the Clerk were presented and
considered.
NOW THEREFORE, this Council, having heard and considered all objections so
presented, and being fully advised in the premises, and having made all necessary adjustments
and conections, finds that each of the lots, pieces and parcels of land enumerated in the proposed
assessment roll was and is specially benefited by the construction of said improvements in not less
than the amount of the assessment, as corrected, set opposite the description of each such lot,
piece and parcel of land, respectively, and that such amount so set out is hereby levied agai.nst
each of the respective lots, pieces and parcels of land therein described; and
BE IT FiJRTHER RESOLVED, that the proposed assessment roll when adopted and
confumed as to the proper special assessment for each of said lots, pieces and parcels of land
respectively, and the assessment against each parcel, together with interest at the rate of seven
percent (7 %) per annum accruing on the full amount thereof from time to time unpaid, shall be a
lien concurrent with general taxes upon such parcel and all thereof. The total amount of each
assessment as to street reconstxuction/rehabilitation improvements shall he payable in equal
amounts extending over a period of nineteen (19) years; the first of said installments, together
with interest on the entire assessment commencing thirty (30) days from the date of the official
letter of assessment to December 31, 1998, to be payable with general taxes for the year 1998,
collectible in 1999, one of each of the remai.ning installments, together with one year's interest on
that and all other unpaid installments, to be payable with general taxes for each consecutive year
thereafter until the entire assessment is paid.
BE IT FITRTHER RESOLVED, that prior to November 5, 1998 the owner of any lot,
piece or parcel of land assessed hereby may at any time pay the whole of such assessment,
without interest to the City Treasurer; and
BE IT FiJRTHER RESOLVED, that the Clerk shall prepare and transmit to the County
Auditor a certified duplicate of said assessment roll with each then unpaid installment and interest
set forth separately, to be extended upon the proper tax lists of the County, and the County
Auditor shall thereafter collect said assessments in the manner provided by law.
