RESOLUTION 98- 84
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT
TO PLACE THREE BANKS OF FOUR ANTENNAE EACH
ON THE MIJNICIPAL WATER TOWER ON LEXINGTON AVENUE
AND TO INSTALL ACCESSORY EQUIPMENT OUTSIDE THE TOWER
WHEREAS, Mr. Steven P. Katkov of APT has applied for a Conditional Use
Permit to place three banks of four antennae each on the Municipal Water Tower on
Lexington Avenue and to install accessory equipment outside the Tower, as proposed on
plans on file in Planning Case No. 98-39; and
WHEREAS, The Planning Commission of the City of Mendota Heights discussed
this application at their regular meeting on October 27, 1998; and
WHEREAS, The Planning Commission held a public hearing on this application at
their October 27, 1998 meeting; and
WHEREAS, The Planning Commission voted 5-0 (with one Commissioner absent
and one Commissioner in abstention) on October 27, 1998 to recommend that the City
Council approve this application under certain conditions,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit to place three banks of four
antennae each on the Municipal Water Tower on Lexington Avenue and to install
accessory equipment outside the Tower, as proposed on plans on file in Planning Case No.
98-39 is hereby approved under the following conditions:
1. that the equipment is removed within six months of when the operation ceases
2. that proof of any applicable state or federal licenses is submitted
3. that written agreement is given to support, participate in, and refrain from interfering
with public warning systems and public safety communications
4. that all FCC standards and regulations are met
5. that a report guaranteeing non-interference with other communications is submitted
6. that an abandonment bond is furnished to the City equal to one and one half times the
current cost of removal and disposal
7. that a map of all existing and future towers and antennae of the same provider is
submitted to the City
8. That the ground equipment be located at the northeast corner of the water tower
according to the drawing on file dated November 13, 1998
9. That the City and the Applicant execute a Lease Agreement for the water tower space
10. That the Council review and approve independently both the Lease Agreement and the
equipment located on the ground.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this approved Conditional Use Pernut to place three banks of four antennae
each on the Municipal Water Tower on Lexington Avenue and to install accessory
equipment outside the Tower, as proposed on plans on file in Planning Case No. 98-37
under the above conditions would not have an adverse impact on the health, safety and
general welfare of the citizens of the community and the surrounding land, and would not
be adverse to the general purpose and intent of the Zoning Ordinance.
