RESOLUTION 98- 91
A RESOLUTION APPROVING BUILDING PERMIT AUTHORIZATION
AND A 10 FOOT REAR YARD SETBACK VARIANCE FOR PARHING
FOR 2360 PILOT KNOB ROAD AND 2331-2373 WATERS DRIVE
WHEREAS, Mr. Robert Cote of CB Richard Ellis has applied for a 10' rear yard
setback variance for parking for 2360 Pilot Knob Road and 2331-2373 Waters Drive as
proposed on plans on file in Planning Case No. 98-33; and
WHEREAS, The Planning Commission of the City of Mendota Heights discussed
this application at their regular meeting on September 22, 1998; and
WHEREAS, The Planning Commission held a public hearing on this application at
their September 22, 1998 meeting; and
WHEREAS, The Planning Commission voted 6-1 on September 22, 1998 to
recommend that the City Council approve this application under certain conditions,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a 10' rear yard setback variance for parking for 2360 Pilot
Knob Road and 2331-2373 Waters Drive and building pernut authorization to add 27
truck docks as proposed on plans on file in Planning Case No. 98-33 is hereby approved
under the following conditions:
That the applicant impleinent the landscape plan labeled "L1: Level 1 Landscape Plan -
City Submittal" dated November 23, 1998 and submitted to the Council for their
December 1, 1998 meeting showing that trees will be added to screen the 2360 Pilot
Knob Road parking lot and the north end of the 2360 Pilot Knob Road building
2. That the applicant move the truck storage area from along Pilot Knob Road to the
north end of the building and designate the north end of the building as the truck
storage area as proposed.
3. That the applicant remove the chain-link fence against the pond on the west side of the
2360 Pilot Knob Road building
4. That the applicant combine the triangle lot immediately east of and adjacent to the
Gateway Commons parcel with the Gateway Commons parcel
5. That a green space or berm area of 18-20 feet wide is placed on the east side of the
new dock area of the 2360 Pilot Knob Road building

That a cross-access easement is filed between 2360 Pilot Knob Road and the Gateway
Commons building to ensure common traffic access and parking usage.
That all of the requirements of the City Engineer are met.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this approved 10' rear yard setback variance for parking for 2360 Pilot Knob
Road and 2331-2373 Water Drive and building pernut authorization to add 27 truck docks
as proposed on plans on file in Planning Case No. 98-33 under the above conditions would
not have an adverse impact on the health, safety and general welfare of the citizens of the
community and the surrounding land, and would not be adverse to the general purpose
and intent of the Zoning Ordinance.
